The CHAIRI-IAIT announced that agenda items 4 and 9 would he considered together. 3. Mr. van BQVEN (Director, D i v i s i o n of Human Rights), introducing the W o items, r e f e r r e d at length to the relevant resolutions of the Commission and other United Nations bodies c i t e d i n the annotations to the p r o v i s i o n a l ag-enda (E/CN. 4/148 O/Add.l), With regard to Security Council r e s o l u t i o n 497 ( l 9 8 l ) r e l a t i n g to the occupied Syrian Golan Heights, he reminded the Commission that the General Assembly was meeting i n special session to consider the question. Turningto item 9 , he referred to the annotations i n document E/CN.4 /l480 /Add.l l i s t i n g the resolutions concerning the issues covered by tliat item. 4. JMr. MANSOUR (Observer f o r the Palestine Liberation Organization) said that the P a l e s t i n i a n people, deprived of t h e i r most elementary rights,' both c o l l e c t i v e l y and i n d i v i d u a l l y , Jiad an obvious i n t e r e s t i n the establisliment of the rule of lav/ and justice i n international relations. Y/ithin the United Nations, considerable progress had been made towards such a new i^orld order, l a r g e l y through the increasing p a r t i c i p a t i o n . o f the- t h i r d world members, wliich gave i t s consensus declarations a universal v a l i d i t y . But there v m a a widening g u l f betv/een the increasingly detailed resolutions on human r i g h t s that were being adopted and the practice of c e r t a i n States. The Commission, i n p a r t i c u l a r , was faced with the challenge of making i t s basic resolutions operational i n order to preserve the c r e d i b i l i t y of the United Nations and the confidence of the P a l e s t i n i a n people i n i n t e r n a t i o n a l forums. The challenge came from those - i n p a r t i c u l a r , the rulers of I s r a e l and t h e i r supporters - who took advantage of the apparent impotence of the i n t e r n a t i o n a l community, i n order to disregard i t s -expressions o f condemnation. Indeed, I s r a e l i contempt f o r human r i g h t s had assumed alarming proportions over the previous year, as shovm by the examples c i t e d i n the report of the Special Committee to Investigate I s r a e l i P r a c t i c e s ' A f f e c t i n g the Human Rights of the Population of the Occupied T e r r i t o r i e s ' ( A / 3 6 / 5 7 9 ) and the report of the Committee on the Exercise of the Inaliénable Rights of the P a l e s t i n i a n People ( A / 3 6 / 3 5 ) . - -The worst aspect, which boded i l l f o r the future, ?ras the systematic use of repression'as an instrument to b r i n g about a r a d i c a l change i n the Arab character of the occupied t e r r i t o r i e s . 5. The aim of the Z i o n i s t s , v/hether by m i l i t a r y conquest or the use of paramilitary bodies such as the Nahal, was to absorb Palestine and other Arab t e r r i t o r i e s completely. Sometimes settlements were established by force of arms; sometimes the P a l e s t i n i a n population was simply expelled. I s r a e l i v i o l a t i o n s of human r i g h t s should therefore be vievred i n the wider perspective of Zionist aims and the u t t e r negation of the Palestine people. E/CÎI .4 /1982/SR .5 page 3 6. I r o n i c a l l y , t h a t p o l i c y had r e c e n t l y been complemented under cover o f v/hat had been termed a " p r o c e s s " . I n f a c t , w e l l b e f o r e t h e Camp D a v i d a c c o r d s , t h e Arab S t a t e s as a v/hole had i s s u e d a w a r n i n g a g a i n s t n o t o n l y t h e d e f e c t s i n h e r e n t i n t h a t p r o c e s s b u t a l s o i t s adverse e f f e c t s on t h e r i g h t s o f P a l e s t i n i a n and o t h e r Arab p e o p l e s . A n e u t r a l S i n a i f r o n t l e f t I s r a e l f r e e t o a c t e l s e v i h e r e ; and t h e a c t s p e r p e t r a t e d i n the occupied t e r r i t o r i e s , the d e s t r u c t i o n o f the n u c l e a r r e a c t o r i n Baghdad, r e p e a t e d a g g r e s s i o n a g a i n s t t h e Lebanese and P a l e s t i n i a n peoples, i n Lebanon, and t h e a n n e x a t i o n o f t h e G o l a n H e i g h t s had c o n f i r m e d t h e ?rorst f e a r s . I s r a e l c o u l d w e l l uproot 12 ,000 P a l e s t i r d a n s i n t h e n e a r f u t u r e under t h e p r e t e x t o f f r o n t i e r d e l i m i t a t i o n between Egypt and I s r a e l i o c c u p a t i o n f o r c e s a t E a f a h . Camp Da.vid had p r o v i d e d t h e impetus f o r ^varfare and human r i g h t s v i o l a t i o n s , and the S p e c i a l Committee s h o u l d keep a c l o s e eye on events d u r i n g t h e weeks ahead, 7. I s r a e l c o u l d n o t c a r r y o u t such p o l i c i e s v d t h o u t a c t i v e U n i t e d S t a t e s s u p p o r t . Indeed, .the U n i t e d S t a t e s h a d r e c e n t l y s i g n e d a s t r a t e g i c c o - o p e r a t i o n agreement w i t h Israel. Those vfho s a i d t h a t s a n c t i o n s o r f o r m a l o p p o s i t i o n xTOuld f o r c e I s r a e l i n t o g r e a t e r extremism s h o u l d r e c a l l t h a t , as h i s t o r y had shovm, appeasement made m a t t e r s worse; t h e Munich agreement, f o r example, had l e d o n l y t o f u r t h e r a g g r e s s i o n . I s r a e l ' s M i r d s t e r o f Defence had s t a t e d , a c c o r d i n g t o a n a r t i c l e i n M a a r i v dated 18 December 1 9 Q l j t h a t I s r a e l ' s s t r a t e g i c i n t e r e s t s s h o u l d encompass t w o a r e a s , one e n c i r c l i n g thé Arab, c o u n t r i e s and t h e o t h e r e x t e n d i n g t o Turkey, I r a n , P a k i s t a n , the P e r s i a n G u l f and t h e ...tates o f n o r t h and c e n t r a l A f r i c a , That a s m a l l S t a t e l i k e I s r a e l , ?;hose v i o l a t i o n s o f t h e p r i n c i p l e s o f l a w h a d r e p e a t e d l y been.condemned b y t h e i n t e r n a t i o n a l community, c o u l d c o n c e i v e such huge m i l i t a r y and p o l i t i c a l d e s i g n s was due t o t h e m i l i t a r y and m o r a l support i t r e c e i v e d from t h e U n i t e d S t a t e s and t h e p o l i c y o f appeasement adopted b y some European c o u n t r i e s . 8. The P a l e s t i n i a n s ' homeland was b e i n g n o t o n l y d e s p o i l e d b u t used as a s p r i n g b o a r d f o r a s s a u l t s on t h e independence o f Arab a,nd o t h e r p e o p l e s elsewhere i n t h e r e g i o n . The P a l e s t i n i a n p e o p l e ' s r i g h t s had been r e p e a t e d l y u p h e l d i n U n i t e d N a t i o n s resolutions. The s t r u g g l e t o defend those r i g h t s w a s a t one v/ith t h e a n t i - c o l o n i a l s t r u g g l e b e i n g v/aged b y t h e p e o p l e s o f s o u t h e r n A f r i c a , w i t h whom t h e P a l e s t i n i a n s were p r o u d t o be a s s o c i a t e d . 9. I t v/as up t o t h e i n t e r n a t i o n a l community t o h e l p a v e r t t h e t h r e a t s he had r e f e r r e d t o ; and i t v;as up t o c e r t a i n Member S t a t e s t o demonstrate t h a t m i l i t a r y might was n o t t h e s o l e d e t e r m i n i n g f a c t o r i n i n t e r n a t i o n a l r e l a t i o n s . Otherwise, the P a l e s t i n i a n and o t h e r Arab p e o p l e s , and p e o p l e s elsewhere i n t h e t l i i r d w o r l d , T/ould be f o r c e d t o conclude t h a t t h e y c o u l d r e c o v e r t h e i r r i g i i t s o n l y b y d e v e l o p i n g t h e i r own p o t e n t i a l , whatever t h e c o s t . B u t v/hile p u r s u i n g i t s s t r u g g l e , h i s o r g a n i z a t i o n would c o n t i n u e t o a p p e a l t o t h e i n t e r n a t i o n a l .community. 10. Mr. DAPUDY ( S y r i a n Arab R e p u b l i c ) c o n g r a t u l a t e d , Pérez de C u e l l a r on h i s appointment as S e c r e t a r y - G e n e r a l o f t h e U n i t e d N a t i o n s , and p a i d t r i b u t e t o t h e s e r v i c e r e n d e r e d b y l i e , Waldheim i n t h a t p o s t , 11. The s i t u a t i o n i n t h e I s r a e l i - o c c u p i e d t e r r i t o r i e s was growing worse. The o c c u p a t i o n o f t h e S y r i a n G o l a n H e i g h t s , i n fla,grant v i o l a t i o n o f t h e C h a r t e r , w a s the l a t e s t i n a s e r i e s o f measures t a k e n i n d e f i a n c e o f t h e i n t e r n a t i o n a l community. As n o t e d b y t h e S p e c i a l Committee i n paragraph 4OI o f i t s r e p o r t (A /36/579) > t h e c i v i l i a n p o p u l a t i o n o f t h e o c c u p i e d t e r r i t o r i e s were d e n i e d even t h e i r most b a s i c r i g h t s , I s r a e l ' s a c t i o n s had been condemned many t i m e s b y t h e Commission, t h e S e c u r i t y C o u n c i l and t h e G e n e r a l Assembly, as v r e l l as b y s p e c i a l i z e d a g e n c i e s and independent b o d i e s concerned vàth human r i g h t s . The condemnations o f I s r a e l f o r v i o l a t i n g human r i g h t s E/CIT.4/1982/SR,5 ·page 4 i n the o c c u p i e d Arab t e r r i t o r i e s , r e f u s i n g t o a p p l y the Geneva C o n v e n t i o n r e l a t i v e t o the P r o t e c t i o n o f C i v i l i a n P e r s o n s i n Time o f War, c o m m i t t i n g v/ar c r i m e s i n those t e r r i t o r i e s , c a r r y i n g out l a r g e - s c a l e ' a r r e s t s and d e p o r t a t i o n s , d e s t r o y i n g homes, p i l l a g i n g - a r c h a e o l o g i c a l s i t e s , i l l e g a l l y e x p l o i t i n g n a t u r a l r e s o u r c e s - a l l those condemnations showed how u t t e r l y I s r a e l had i s o l a t e d i t s e l f from the i n t e r n a t i o n a J community. 12. I n December I 9 O I the I&iesset h a d : v o t e d t o s u b j e c t an e n t i r e r e g i o n t o I s r a e l i law and j u r i s d i c t i o n . However, tlie i n h a b i t a n t s o f the S^rrian G o l a n H e i g h t s had r e f u s e d t o exchange t h e i r S y r i a n i d e n t i t y c a r d s . Tho Z i o n i s t a u t h o r i t i e s , not c o n t e n t . w i t h t u r n i n g more t h a n 200,000 S y r i a n c i t i z e n s i n t o r e f u g e e s , had c y n i c a l l y d e c l a r e d the r e g i o n t o be I s r a . e l i t e r r i t o r y . 13.. The comparison o f the f a t e o f the P a l e s t i n i a n people a t the hands o f the Z i o n i s t a u t h o r i t i e s T i l t h t h a t of the Csech p e o p l e i n the Sudeten r e g i o n annexed by H i t l e r b e f o r e the Second T i o r l d War vias v e r y r e l e v a n t . I n b o t h cases a n n e x a t i o n had been · j u s t i f i e d by a l l e g e d s e c u r i t y needs and s p u r i o u s e t h n i c and h i s t o r i c a l grounds. 14. A l t h o u g h ' t h e S e c u r i t y C o u n c i l had adopted a r e s o l u t i o n on 17 December I 9 O I d e c l a r i n g the I s r a e l i a n n e x a t i o n o f the G o l a n H e i g h t s n u l l and v o i d , the demand f o r s a n c t i o n s had been b l o c k e d by the U n i t e d S t a t e s v e t o , . o n l y s e r v e d t o encourage such a g g r e s s i o n . I s r a e l i a g g r e s s i o n s u p p o r t e d by the "United S t a t e s c o n s t i t u t e d a grave danger, not o n l y f o r S y r i a but a l s o f o r i n t e r n a t i o n a . l peace, and i t v/as t o be f e a r e d t h a t I s r a e l i - U n i t e d S t a t e s c o l l u s i o n vrould c o n s t i t u t e a dangerous p r e c e d e n t t h r e a t e n i n g the independence and t e r r i t o r i a l i n t e g r i t y o f o t h e r c o u n t r i e s , · I t was. even more i r o n i c t o h e a r the v e r y c o u n t r i e s t h a t c o n n i v e d a t I s r a e l i a g g r e s s i o n speak: o f the need t o r e s p e c t human r i g h t s and the p r i n c i p l e s o f the U n i t e d N a t i o n s Charter. I s r a e l , t h r o u g h i t s r e p e a t e d v i o l a t i o n s o f the C h a r t e r and the U n i v e r s a l D e c l a r a t i o n o f Human R i g h t s , had f u r n i s h e d ample p r o o f t h a t i t d i d not deserve t o r e m a i n a Member o f the U n i t e d Hâtions and i t vrould be i n the i n t e r e s t s o f the i n t e r n a t i o n a l community t o e x p e l i t . I s r a e l ' s d e f i a n t b e h a v i o u r , s u p p o r t e d by the U n i t e d S t a t e s , undermined the a u t h o r i t y and v e r y e x i s t e n c e o f tho U n i t e d Hâtions, v/hich must defend the, hopes t h a t the p e o p l e s o f the w o r l d had p l a x e d i n i t . 15. How was a s m a l l c o u n t r y l i k e I s r a e l a b l e t o m a i n t a i n a p o l i c y o f a g g r e s s i o n , . e x p u l s i o n and d e m o l i t i o n , and t o f l o u t internr,tion<."i 1 ; : ; , 7 and a u t h o x i t y ? That s u f f e r i n g was u n d e n i a b l e and y e t i t was u n j u s t t o malee the P a l e s t i n i a n people pay f o r the c r i m e s o f European a n t i - s e m i t i s m , Yiihy had the B r i t i s h Government d e c i d e d t o i s s u e the B a l f o u r D e c l a r a t i o n o f 191? > w h i c h promised a l a n d t h a t d i d not b e l o n g t o i t t o p e o p l e who had never been i n P a l e s t i n e ? . That D e c l a r a t i o n had l e d t o an . a n t i P a l e s t i n i a n and a n t i - A r a b v;ar'which had begun v/hen B r i t i s h t r o o p s had entered-.. . . P a l e s t i n e and c o n t i n u e d t o the p r e s e n t day, now w i t h U n i t e d S t a t e s s u p p o r t . I t could even be s a i d t h a t the e n t i r e w o r l d was p a y i n g the p r i c e f o r u n c o n d i t i o n a l support by the U n i t e d S t a t e s f o r I s r a e l . Hot o n l y was the moribund I s r a e l i economy b e i n g propped up by b i l l i o n s o f d o l l a r s i n i n v e s t m e n t s but I s r a e l had been t r a n s f o r m e d i n t o an advance. L i b e r a t i o n O r g a n i z a t i o n as an o r g a n i z a t i o n of mui'derers and t e r r o r i s t s . Those s a n e I s r a e l i l e t i d e r s v;ere...nov; soviing death and d e s o l a t i o n i n P a l e s t i n e r e f u g e e camps i n southern Lebanon a^nd even i n the h e a r t of B e i r u t . 17. He d i d not v i i s h t o i m p l y t h a t a l l Jevjs i n I s r a e l and elsev /here supported the huEian r i g h t s v i o l a t i o n s coniuitted a g a i n s t the A r a b m i n o r i t y i n I s r a e l and the occupied t e r r i t o r i e s . Courageous men such as P r o f e s s o r Iloshe Menuhin, P r o f e s s o r I s h a k Shahag and a number of lav /yers had spoken out a g a i n s t the I s r a e l i treatment o f A r a b s i n the o c c u p i e d t e r r i t o r i e s and. the a n n e x a t i o n o f the G o l a n H e i g h t s , and had t r i e d t o p r o v i d e l e g a l defence f o r P a l e s t i n i a n d e t a i n e e s . ' U n f o r t u n a t e l y , those fe\j courcLgeous v o i c e s were l o s t amid the mass of s y s t e m a t i c v i o l a t i o n s o f human r i g h t s and m i l i t a r i s t a m b i t i o n s of the I s r a e l i Government. 18. The I l i d d l e E a s t \.'as unfortuna:.tely an a r e a coveted by the U n i t e d S t a t e s i m p e r i a l i s t s f o r i t s n a t u r a l i-esourceo and i t s s t r a . t e g i c p o s i t i o n . Uhen A r a b d e l e g a t e s had sought to c o n v i n c e o t h e r s i n the 1 9 5 0 s and I9ÓO0 t h a t I s r a e l was not s i m p l y a s m a l l e n c l a v e o f i-efugees from, the N a s i e x t e r m i n a t i o n camps but an advanced base of U n i t e d S t a t e s i m p e r . i a l i s m , no one had b e l i e v e d them, N 0 1 7 , however, a f t e r the many v/ars of a g g r e s s i o n launched by I s i - a e l w i t h U n i t e d S t a t e s s u p p o r t , the t r u e n a t u r e of t h a t S t a t e was c l e a r to everyone. There c o u l d be no v a l i d excuse f o r United. S t a t e s support of 'the I s r a e l i a g g r e s s o r o r f o r i t s e f f o r t s to p r e v e n t the i n t e r n a t i o n a l community from demanding the a p p l i c a t i o n of the measures provid.ed f o i " under the U n i t e d N a t i o n s C h a r t e r . How c o u l d one U n i t e d S t a t e s a d m i n i s t r a t i o n a f t e i a n o t h e r c o n t i n u e to j u s t i f y i t s support f o r I s r a e l , thus e n c o u r a g i n g I s r a e l i aggression? could the U n i t e d S t a t e s c o n t i n u e to oppose the P a l e s t i n i a n p e o p l e i n i t s e f f o r t s to e n j o y . I n i t s r e s o l u t i o n adopted unanimously on 1 7 December 1981s t h e S e c u r i t y C o u n c i l had d e c i d e d t h a t the d e c i s i o n by I s r a e " t o impose i t s l¿iws, j u r i s d i c t i o n and a d m i n i s t r a t i o n i n t h e o c c u p i e d S y r i a n G o l a n H e i g h t s \/as n u l l and v o i d and w i t h o u t i n t e r n a t i o n a l l e g a l e f f e c t , and i t had demanded t h a t I s r a e l should r e s c i n d i t s d e c i s i o n . A s - u s u a l , t h e I s r a e l i Government r e f u s e d t o comply.with t h e S e c u r i t y C o u n c i l r e s o l u t i o n . I t \;as t h e r e f o r e e s s e n t i a l f o r t h e i n t e r i x i t i o n a l community t o a s s u m e i t s r e s p o n s i b i l i t y by p r o c e e d i n g beyond the stage o f . v e r b a l condemnation and d e c i d i n g t o impose s a n c t i o n s on I s r a e l . Only such s a n c t i o n s would i n d u c e the Z i o n i s t a u t h o r i t i e s t o m o d i f y t h e i r p o s i t i o n . I n d e e d , e x p e r i e n c e had a h o i m t h a t t h o s e a u t h o r i t i e s took l i t t l e n o t i c o o f condemnations and c o n t i n u e d t o a p p l y t h e i r e x p a n s i o n i s t p o l i c y t o t h e d e t r i m e n t o f the sovereign States o f the region. I t was q u i t e c l e a r t h a t , u n l e s s p r a c t i c a l measures were t a k e n , the p o l i c y o f e s t a b l i s h i n g s e t t l e m e n t s would c o n t i n u e and even be extended t o the West Bank and Gaza. The Z i o n i s t l e a d e r s d i d not c o n c e a l t h e i r i n t e n t i o n s i n t h a t r e g a r d , as had been made c l e a r by the I s r a e l i P r i m e M n i s t e r i n p r e s e n t i n g h i s programme t o the Knesset. 27. F o r more than 34 y e a r s , the p e o p l e o f P a l e s t i n e had been d e p r i v e d o f i t s f-undamental r i g h t s . E v e r y y e a r , on the o c c a s i o n o f the c o n s i d e r a t i o n o f the p r e s e n t i t e m , the I s r a e l i a u t h o r i t i e s adopted an i n c r e a s i n g l y i n t r a n s i g e n t a t t i t u d e . R e f e r r i n g t o the h u m i l i a t i n g and v i o l e n t c o n d i t i o n s i n w h i c h the s e t t l e m e n t s were e s t a b l i s h e d he s a i d t h a t p r i v a t e armed m i l i t i a s , a c t i n g i n connivance w i t h the I s r a e l i a u t h o r i t i e s , t e r r o r i z e d the ./rab p o p u l a t i o n s and drove them from t h e i r l a n d s . Groups such as "Gush Emunim" and "Kach" had become n o t o r i o u s f o r t h a t type o f o p e r a t i o n . . I s r a e l , a "South A f r i c a o f the M i d d l e E a s t " , deserved the f r i e n d s h i p , s u p p o r t and s o l i d a r i t y o f i t s c o u n t e r p a r t i n A f r i c a s i n c e they b o t h pursued the same g o a l by p r a c t i s i n g the same p o l i c y . 29. E e p r e s s i o n by the I s r a e l i a u t h o r i t i e s i n the o c c u p i e d t e r r i t o r i e s t o o k the form o f the d y n a m i t i n g o f homes and c u r f e w s , w h i c h sometimes l a s t e d f o r s e v e r a l days and p r o v i d e d the I s r a e l i army w i t h an o p p o r t u n i t y t o c a r r y out a l l s o r t s o f i l l e g a l a c t s a g a i n s t the Arab p o p u l a t i o n s . E d u c a t i o n a l i n s t i t u t i o n s had not been s p a r e d by the r e p r e s s i o n , and s e v e r a l s c h o o l s and u n i v e r s i t i e s had been c l o s e d d u r i n g the p a s t y e a r . Moreover, severe r e s t r i c t i o n s had been imposed on freedom o f movement, a f f e c t i n g a l l persons i n the o c c u p i e d t e r r i t o r i e s . However, those d e s p i c a b l e p r a c t i c e s were o f no a v a i l a g a i n s t the d e t e r m i n a t i o n o f the h e r o i c p e o p l e o f P a l e s t i n e t o i n t e n s i f y i t s f i g h t t o put an end t o i n j u s t i c e and r e c o v e r i t s . f u l l r i g h t s . 30. The s i t u a t i o n o f Arab d e t a i n e e s gave cause f o r s e r i o u s c o n c e r n . A c c o r d i n g t o the r e p o r t o f the S p e c i a l Committee, 2 0 0 , 0 0 0 persons had been i m p r i s o n e d f o r p o l i t i c a l reasons s i n c e the b e g i n n i n g o f the o c c u p a t i o n , i . e . n e a r l y 20 p e r cent o f the t o t a l p o p u l a t i o n o f the A r a b t e r r i t o r i e s .
