I n d e f i a n c e o f the P a l e s t i n i a n p e o p l e ' s o p p o s i t i o n and o f w o r l d p u b l i c o p i n i o n , I s r a e l c o n t i n u e d i n c e s s a n t l y t o e n c r o a c h upon Arab l a n d , h a v i n g a c c e l e r a t e d the e x p a n s i o n o f s e t t l e m e n t s on the V e s t Bank and the Gaza S t r i p and d e c l a r e d t h a t , w i t h i n the n e x t f i v e y e a r s , the number o f s e t t l e m e n t s would be i n c r e a s e d from the c u r r e n t I03 t o I 6 0 and t h a t the number o f J e w i s h 3.mmigrants would r e a c h 100,000. On the West Banlc and the Gaza S t r i p , P a l e s t i n i a n l a n d was b e i n g c o n f i s c a t e d and the n a t u r a l r e s o u r c e s p l u n d e r e d ; the aim was c l e a r l y t o change the c h a r a c t e r o f the o c c u p i e d t e r r i t o r i e s , p e r p e t u a t e I s r a e l ' s m i l i t a i y o c c u p a t i o n and t h u s p r e v e n t the P a l e s t i n i a n s from r e c o v e r i n g t h e i r homeland. 2. A l s o d u r i n g the p a s t y e a r I s r a e l had expanded i t s m i l i t a r y o c c u p a t i o n o f Arab t e r r i t o r i e s t h r o u g h i t s armed a g g r e s s i o n a g a i n s t Lebanon - y e t a n o t h e r p r o v o c a t i v e a c t a g a i n s t the Arab c o u n t r i e s and p e o p l e s and a g a i n s t n a t i o n s w h i c h u p h e l d j u s t i c e . S i n c e 1973» I s r a e l had b r u t a l l y t r a m p l e d on Lebanon's s o v e r e i g n t y and t e r r i t o r i a l i n t e g r i t y , f l a g r a n t l y v i o l a t i n g the C h a r t e r and b a s i c norms o f i n t e r n a t i o n a l r e l a t i o n s . Worse s t i l l , I s r a e l had caused the t r a g i c massacres a t the Sabra and C h a t i l a . r e f u g e e camps. I s r a e l ' s w i l f u l , v i o l a t i o n o f the Geneva C o n v e n t i o n R e l a t i v e t o the P r o t e c t i o n o f C i v i l i a n P e r s o n s i n Time o f V/ar ( f o u r t h Geneva C o n v e n t i o n ) had r e a c h e d g e n o c i d a l p r o p o r t i o n s , .for which i t s a u t h o r i t i e s c o u l d not evade r e s p o n s i b i l i t y , I s r a , e l ' s a u d a c i t y stemmed from the s u p p o r t i t r e c e i v e d from one su-psr-Pox/er, w h i c h e n s u r e d t h a t the c o n t i n u e d v i o l a t i o n s o f human r i g h t s i n the o c c u p i e d Arab t e r r i t o r i e s went unchecked. 3. The P a l e s t i n i a n p e o p l e ' s j u s t s t r u g g l e , d e s p i t e temporary s e t b a c k s , was g a i n i n g e v e r more support, as r e f l e c t e d i n i m p o r t a n t r e s o l u t i o n s adopted i n 1982 by the S e c u r i t y a t emergency s e s s i o n s and by the G e n e r a l Assembly a t i t s resumed s e v e n t h emergency s p e c i a l s e s s i o n . The G e n e r a l Assembly, a t i t s t h i r t y - s e v e n t h s e s s i o n , had a l s o a d o p t e d - by an overv/helming m a j o r i t y - a r e s o l u t i o n demanding I s r a e l ' s w i t h d r a w a l from the Arab t e r r i t o r i e s o c c u p i e d s i n c e I 9 6 7 and the r e s t o r a t i o n o f the P a l e s t i n i a n p e o p l e ' s n a t i o n a l r i g h t s , C h i n a had p a r t i c i p a t e d i n , and s u p p o r t e d the f i n d i n g s - o f , the Seminar on v i o l a t i o n s o f humaja r i g h t s i n the P a l e s t i n i a n and o t h e r Arab t e r r i t o r i e s o c c u p i e d by I s r a e l , ( w h i c h had r e a f f i r m e d the P a l e s t i n i a n p e o p l e ' s i n a l i e n a b l e r i g h t o f s e l f - d e t e r m i n a t i o n and condemned t h e many c r i m e s committed by the I s r a e l i a u t h o r i t i e s . F i r s t l y , the r i g h t o f t h e P a l e s t i n i a n s t o r e t u r n t o t h e i r homeland and t o e x e r c i s e n a t i o n a l s e l f - d e t e r m i n a t i o n and s t a t e h o o d must be r e s t o r e d . S e c o n d l y , I s r a e l must vri.thdraw from a l l t h e t e r r i t o r i e s i t had o c c u p i e d s i n c e 196?, i n c l u d i n g J e r u s a l e m and Lebanon, and must be made t o s t o p i t s a n n e x a t i o n s and a t r o c i t i e s . T h i r d l y , tho r e l e v a n t G e n e r a l Assembly and S e c u r i t y C o u n c i l r e s o l u t i o n s must be implemented and I s r a e l s t r o n g l y condemned f o r a l l i t s a c t s i n b r e a c h o f those r e s o l u t i o n s , t h e C h a r t e r and the norms o f i n t e r n a t i o n a l l a w . F o u r t h l y , i n the event o f war and armed c o n f l i c t and i n t h e o c c u p i e d t e r r i t o r i e s , c i v i l i a n s must be p r o t e c t e d . s t r i c t l y i n accordance w i t h t h e f o u r t h Geneva C o n v e n t i o n ; t h e I s r a e l i a u t h o r i t i e s must c o n s e q u e n t l y be p u n i s h e d f o r t h e k i l l i n g o f c i v i l i a n s . F i f t h l y , I s r a e l must r e l e a s e a l l A r a b s d e t a i n e d a s a r e s u l t o f t h e i r s t r u g g l e f o r s e l f - d e t e r r a i n a t i o n and, pending t h e i r r e l e a s e , cease a l l a c t s o f t o r t u r e and i l l - t r e a t r a e n t and a c c o r d t h e d e t a i n e e s t h e p r o t e c t i o n envisaged i n the r e l e v a n t i n t e r n a t i o n a l instruments. S i x t h l y , the i n t e r n a t i o n a l community must p r o v i d e a l l m o r a l , m a t e r i a l and d i p l o m a t i c a s s i s t a n c e t o t h e P a l e s t i n i a n p e o p l e a n d d e s i s t from s u p p o r t i n g I s r a e l w h i l e t h e l a t t e r vfas p u r s u i n g i t s e x p a n s i o n i s t p o l i c i e s and v i o l a t i n g human r i g h t s i n t h e o c c u p i e d t e r r i t o r i e s . S e v e n t h l y , t h e e i g h t p r i n c i p l e s adopted a t t h e t w e l f t h Arab Summit Conference a t F e z p r o v i d e d a sound b a s i s f o r a j u s t and comprehensive, s e t t l e m e n t o f the I'iiddle E a s t q u e s t i o n . The PLO s h o u l d p a r t i c i p a t e i n a l l e f f o r t s t o s e t t l e t h e problems o f P a l e s t i n e and t h e M i d d l e E a s t a s a whole. 5. Mr. CHOVfflHUHY ( B a n g l a d e s h ) said t h a t y e a r a f t e r y e a r , i n v a r i o u s i n t e r n a t i o n a l forums, t h e v o i c e o f j u s t i c e had b e e n v a i n l y c a l l i n g f o r a n end t o t h e s u f f e r i n g of. the p e o p l e s o f the o c c u p i e d Arab t e r r i t o r i e s , i n c l u d i n g P a l e s t i n e . The r i g h t s o f s e l f - d e t e r m i n a t i o n h a d l o n g been r e c o g n i z e d , b e i n g e n s l i r i n e d i n t h e C h a r t e r and i n a r t i c l e 1 o f t h e I n t e r n a t i o n a l Covenants. The Palestiràans, h a v i n g t h e i r own c u l t u r e , r e l i g i o n and r a c e , c o n s t i t u t e d a p e o p l e , and t h e i r r i g h t s had been r e c o g n i z e d a s such i n a number o f U n i t e d N a t i o n s r e s o l u t i o n s . B u t t h e U n i t e d N a t i o n s seemed.powerless to remedy t h e d e n i a l o f t h e P a l e s t i n i a n p e o p l e ' s r i g h t t o r e c o v e r i t s homeland and l i v e t h e r e i n freedom, s e c u r i t y and d i g n i t y . Indeed, t h e o c c u p a t i o n o f Arab l a n d s was i n c r e a s i n g , i n d e f i a n c e o f the numerous r e s o l u t i o n s adopted, and t h e popiüation o f the o c c u p i e d t e r r i t o r i e s vras b e i n g s u b j e c t e d t o d i s c r i m i n a t i o n and d e n i e d t h e enjoyment o f e q u a l r i g h t s and o p p o r t u n i t i e s . I s r a e l ' s o c c u p a t i o n o f J e r u s a l e m vras i n f l a g r a n t d i s r e g a r d o f w o r l d p u b l i c o p i n i o n and u n i t e d N a t i o n s r e s o l u t i o n s . Likevrise, r e s o l u t i o n s c a l l i n g f o r humane treatment o f p e r s o n s i m p r i s o n e d b y t h e I s r a e l i a u t h o r i t i e s h a d been i n e f f e c t t u x l . 6. The o n l y r e a s o n a b l e course open t o t h e U n i t e d N a t i o n s \ías t o implement i t s r e s o l u t i o n s , c a l l i n g o n I s r a e l , a s a Member S t a t e , t o comply w i t h them. I s r a e l must r e l e a s e a l l i t s p r i s o n e r s s i n c e i t was unable, to t r e a t then i n accordance v/ith t h e p r o v i s i o n s o f t h e Geneva C o n v e n t i o n s . The U n i t e d J J a t i n n e must tabe s t e p s , t o enable the P a l e s t i n i a n p e o p l e t o r e c o v e r i t s homeland and a l l p e a c e - l o v i n g n a t i o n s s h o u l d " g i v e m a t e r i a l a s s i s t a n c e f o r t h a t purpose. I t was f o r the. P a l e s t i n i a n s t h e m s e l v e s , t h r o u g h t h e i r s o l e l e g i t i m a t e r e p r e s e n t a t i v e - t h e PLO, t o determine t h e i r f u t u r e . Mr. KONSTANTINOV ( B u l g a r i a ) s a i d h i s d e l e g a t i o n was d e e p l y p e r t u r b e d b y t h e f a c t t h a t t h e q u e s t i o n r a i s e d i n agenda i t e m 4 h a d f o r seme 35 y e a r s p a s t b e e n on t h e agendas o f v a r i o u s U n i t e d N a t i o n s b o d i e s , i n c l u d i n g t h e G e n e r a l Assembly, t h e S e c u r i t y C o u n c i l and t h e Commission. D e s p i t e t h e numerous r e s o l u t i o n s a d o p t e d and the i n t e r n a t i o n a l community's e f f o r t s , t h e v i o l a t i o n s o f r i g h t s i n the occupied t e r r i t o r i e s , i n c l u d i n g P a l e s t i n e , and t h e o v e r a l l s i t u a t i o n i n t h e M i d d l e E a s t c o n t i n u e d t o w o r s e n and remained among t h e g r a v e s t o f c u r r e n t problems, s e r i o u s l y t h r e a t e n i n g i n t e r n a t i o n a l peace and s e c u r i t y . The U n i t e d N a t i o n s faced, a s i t u a t i o n i n w h i c h a S t a t e h a d f o r many y e a r s p u r s u e d a p o l i c y o f o p p r e s s i o n , v i o l a t i n g r e c o g n i z e d norms o f i n t e r n a t i o n a l l a w and numerous u n i t e d N a t i o n s r e s o l u t i o n s . I s r a e l ' s i l l e g a l o c c u p a t i o n o f A r a b t e r r i t o r i e s s i n c e 1967 and i t s Government's a c t s of a g g r e s s i o n and o p p r e s s i o n were c l e a r l y d e s i g n e d t o change t h e l e g a l s t a t u s , geographic. n a t u r e and demographic c o n s t i t u t i o n o f t h o s e t e r r i t o r i e s , t h r o u g h d e p o r t a t i o n , e x p u l s i o n and d e n i a l o f t h e r i g h t t o r e t u r n , t h u s g r o s s l y v i o l a t i n g the i n h a b i t a n t s ' human r i g h t s . C o n f i s c a t i o n and e x p r o p r i a t i o n o f p r i v a t e and p u b l i c Arab p r o p e r t y , d e s t r u c t i o n o f houses, c o l l e c t i v e punishment, a r b i t r a r y a r r e s t , d e t e n t i o n and i l l - t r e a t m e n t were common I s r a e l i p r a c t i c e s i n f l i c t e d on t h e A r a b p o p u l a t i o n o f the occupied t e r r i t o r i e s . So t o o were t h e measures aimed a t d e s t r o y i n g t h e e d u c a t i o n a l system and t h e s o c i a l and economic development o f t h e Arab p e o p l e , and t h e i l l e g a l e x p l o i t a t i o n o f t h e t e r r i t o r i e s ' nat-ural and hiunan r e s o u r c e s . 9. A s t h e S p e c i a l Committee t o i n v e s t i g a t e I s r a e l i p r a c t i c e s i n the-acfiapieà : t e r r i t o r i e s h a d s t a t e d I n i t s r e p o r t ( A / 3 7 / 4 8 5 ) , i t was v i t a l t o r e a l i s e that, t h e v i o l a t i o n of r i g h t s i n those t e r r i t o r i e s would cease .only when t h e P a l e s t i n i a n people was a l l o w e d t o e x e r c i s e i t s r i g h t o f s e l f - d e t e r m i n a t i o n . , The d e n i a l o f t h a t r i g h t remained t h e major o b s t a c l e t o t h e r e s t o r a t i o n o f peace and s e c u r i t y i n t h e region. A s h a s b e e n p o i n t e d o u t d u r i n g t h e Seminar o n v i o l a t i o n s o f human r i g h t s i n the P a l e s t i n i a n and o t h e r Azab t e r r i t o r i e s o c c u p i e d b y I s r a e l ( S T / H R / S S R . A / 1 4 ) , that: r i g h t c o u l d not be e x t i n g i i i s h e d by c o e r c i v e d i s p l a c e m e n t o f t h e people from t h e t e r r i t o r y ' - once t h e r i g h t had a c c r u e d t o t h a t p e o p l e t h e r e , and t h e r i g h t o f s e l f d e t e r m i n a t i o n i n c l u d e d t h e r i g h t o f t h e P a l e s t i n i a n people t o r e g a i n t h e i r r i g h t s b y a l l means i n accordance v j i t h t h e C h a r t e r . 1 0 . D u r i n g t h e Commission's t h i r t y - e i g h t h s e s s i o n , i t had b e e n s t a t e d t h a t I s r a e l s h o u l d be commended r a t h e r t h a n condemned f o r i t s e f f o r t s t o m a i n t a i n o r d e r , s e c u r i t y and j u s t i c e i n t h e s o - c a l l e d a d m i n i s t e r e d t e r r i t o r i e s . Hov/ever, t h e c u l m i n a t i o n o f t h o s e e f f o r t s had b e e n I s r a e l ' s i n v a s i o n o f Lebanon i n 1982 and t h e r e s u l t a n t d e v a s t a t i o n and l o s s o f l i f e . Enormous niimbers o f people had been d e p r i v e d o f such b a s i c needs;as h o u s i n g , s a n i t a t i o n , m e d i c a l c a r e , f o o d and s e c u r i t y . I s r a e l i t r o o p s , u s i n g s o p h i s t i c a t e d weapons, some o f v h i c h vrere p r o h i b i t e d under . r e l e v a n t i n t e r n a t i o n a l i n s t r u m e n t s , had " " s y s t e m a t i c a l l y and i n d i s c r i m i n a t e l y d e s t r o y e d r e f u g e e camps, h o s p i t a l s , s c h o o l s and s e t t l e m e n t s . D e s p i t e S e c u r i t y C o u n c i l r e s o l u t i o n s , I s r a e l h a d o c c u p i e d almost h a l f o f Lebanon's t e r r i t o r y . The c h i e f v i c t i m s o f t h a t c r i m i n a l war were t h e P a l e s t i n i a n and Lebanese p e o p l e s , whose sufferings represented a b r u t a l denial of the r i g h t t o l i f e . I t s climax had been the c o l d - b l o o d e d massacre, f o r w h i c h t h e S t a t e o f I s r a e l was r e s p o n s i b l e , i n t h e r e f u g e e camps a t Sabra and C h a t i l a , a crime a g a i n s t humanity r e m i n i s c e n t o f N a z i practices. I n v i e w o f I s r a e l ' s deeds d u r i n g the p r e v i o u s y e a r , i t was hard t o u n d e r s t a n d the s t a t e m e n t , r e c e n t l y made i n t h e Commission, t h a t I s r a e l had good r e a s o n t c he p r o u d o f i t s r e c o r d i n the occupied t e r r i t o r i e s . The e x p a n s i o n i s t course adopted I s r a e l was hound t c l e a d t o more w a r f a r e and s u f f e r i n g i n the o c c u p i e d t e r r i t o r i e s , e s p e c i a l l y s i n c e I s r a e l had alvrays r e c e i v e d the u n c o n d i t i o n a l p o l i t i c a l and m i l i t a r y support o f the U n i t e d S t a t e s . The G e n e r a l Assembly, i n v - e s o l u t i o n 56/226 A, had c o n s i d e r e d , i n t e r a - l i a , t h a t t h e agreements on s t r a t e g i c c o - o p e r a t i o n between the U n i t e d S t a t e s and I s r a e l would encourage t h e l a t t e r t o Xjursue i t s a g g r e s s i v e and e x p a n s i o n s i s t p o l i c i e s | t h e t r a g i c r e s u l t o f such c o - o p e r a t i o n had been seen one y e a r l a t e r . The s t r a t e g i c a s p e c t s c l e a r l y i n c l u d e d a polic;'- o f d i v i s i o n , h o s t i l i t y and i n t e r f e r e n c e w i t h t h e r i g h t o f A.rab p e o p l e s , i n c l u d i n g the P a l e s t i n i a n s , t o s e l f - d e t e r m i n a t i o n and p e a c e f u l development. The Gamp l i a v i d a c c o r d s vrere t h e f i r s t o f many d e s t a b i l i z i n g s t e p s w h i c h had l e d t o a c o n s t a n t d e t e r i o r a t i o n o f t h e s i t u a t i o n i n the r e g i o n , t h e e x a c e r b a t i o n o f e x i s t i n g t e n s i o n s and g r o s s v i o l a t i o n s o f human r i g h t s i n t h e occupied t e r r i t o r i e s . The s o - c a l l e d P a l e s t i n i a n autonomy, f a r from b e i n g a remedy, was l i k e l y t o j e o p a r d i z e any j u s t and genuine s o l u t i o n . 12. H i s d e l e g a t i o n ' s views had been expressed many t i m e s i n t h e Commission and o t h e r U n i t e d N a t i o n s b o d i e s . B u l g a r i a condemned I s r a e l ' s a g g r e s s i v e and e x p a n s i o n i s t p o l i c i e s and i t s p e r s i s t e n t and s y s t e m a t i c v i o l a t i o n s o f human r i g h t s i n t h e occupied A r a b t e r r i t o r i e s . I t expressed sympathy, s o l i d a r i t y and support f o r t h e P a l e s t i n i a n p e o p l e i n i t s s t r u g g l e , l e d by i t s s o l e l e g i t i m a t e r e p r e s e n t a t i v e , the PLO. O n l y b y r e c o g n i z i n g the P a l e s t i n i a n s ' r i g h t o f s e l f - d e t e r m i n a t i o n , i n c l u d i n g the r i g h t t o c r e a t e t h e i r own S t a t e , c o u l d a t r u e , e q u i t a b l e and l a s t i n g s o l u t i o n be r e a c h e d . R e p u b l i c s ) s a i d t h a t t h e p e o p l e s o f t h e w o r l d had l o n g condemned t h e c r i m e s committed b y I s r a e l i n t h e oc&upied A x & b t e r r i t o r i e s , but t h e r e c e n t events i n B e i r u t and e l s e w h e r e i n Lebanon could n o t be compared even w i t h those crimes. I s r a e l had begun i t s a g g r e s s i o n i n Lebanon i n June 1982 w i t h a number o f g o a l s : t o d e s t r o y t h e m i l i t a r y f o r c e s and l e a d e r s h i p o f t h e PLO, t o a n n i h i l a t e t h e P a l e s t i n i a n A r a b p e o p l e as a n a t i o n , and t o f o r c e upon Lebanon a peace t r e a t y s i m i l a r t o t h e Gamp David a c c o r d s , thus t e a r i n g a n o t h e r S t a t e away from t h e Arab f r o n t . 14. The b l o o d y war i n Lebanon had shalcen mankind. The heavy c a s u a l t i e s among t h e c i v i l i a n p o p u l a t i o n had n o t been o o i n c i d e n t a l ; t h e mass k i l l i n g s i n West B e i r u t and the massacres i n Sabra and C h a t i l a were t r u e examples o f g e n o c i d e a g a i n s t t h e P a l e s t i n i a n A r a b p e o p l e and were on a p a r w i t h such e v i l deeds as the B a b i Y a r massacre d u r i n g the Second World War. I t was i m p o s s i b l e t o convey the f u l l h o r r o r of the tragedy. The v i c t i m s o f t h e massacre had begged I s r a e l i s o l d i e r s a t t h e g a t e s and r e c o n n a i s a n c e p o i n t s f o r mercy. On a t l e a s t tvro o c c a s i o n s , d e l e g a t i o n s o f women and c h i l d r e n c a r r y i n g a w h i t e f l a g had approached those s o l d i e r s b u t had been s h o t . A group o f d o c t o r s and n u r s e s had a l s o sought s a f e t y under a w h i t e f l a g ; t h e y had been k i l l e d b y a grenade. Many wounded from P a l e s t i n i a n h o s p i t a l s had l a t e r been found shot a t t h e B e i r u t stadium. And on I 7 September, I s r a e l i G e n e r a l E t a n had thanked t h o s e who had c a r r i e d o u t the massacre f o r t h e i r good work. The I s r a e l i .leaders had not h i d d e n t h e f a c t t h a t t h e main g o a l o f t h e i r a c t i o n had been t h e d e s t r u c t i o n o f t h e PIiO and. o f t h e P a l e s t i n i a n people as a h i s t o r i c a l and e t h n i c e n t i t y . The commission had . d e t e i m n e d t h a t I s r a e l was delibearatgiy engaging i n m i l i t a r y a c t i o n against s c i v i l i a n p o p u l a t i o n and bombing p e a c e f u l towns and p o p u l a t e d a r e a s , which was deemed a crime by many i n t e r n a t i o n a l l e g a l i n s t r u m e n t s . 17. The use. of p r o h i b i t e d t y p e s o f weapons was a l s o a d i r e c t v i o l a t i o n o f i n t e r n a t i o n a l c o n v e n t i o n s . The commission had noted t h a t b a r b a r l o weapons o f mass d e s t r u c t i o n had been w i d e l y used i n Lebanon and t h a t the m a j o r i t y of t h e v i c t i m s had been peaceful a i t i a e n s , While 50 per cent of the v i c t i m s of p i l i t a x y a c t i o n during t h e Second World War and 7O p e r cent i n V i e t IS'am had been c i v i l i a n s , t h e f i g u r e îiad reached 90 p e r cent i n Lebanon, The I s r a e l i s had dropped 900-kg Amarican-produced . "VomVs on heavily- p o p u l a t e d areas of Lebanese towns and on P a l e s t i n i a n refugee camps. The bombing by the I s r a e l i a i r f o r c e o f h o s p i t a l s p r o t e c t e d by t h e emblems o f t h e fied Cross .-and the Red .Crescent v i o l a t e d one ,of the o l d e s t noms of biïaanitsrian law* 18. The. coïmission's document a l s o r e f e r r e d to such crimes as the.terforiaatióñ Of t h e c i v i l i a n p o p u l a t i o n , the use o f s t a r v a t i o n as a means of w a r f a r e , t h e c r e a t i o n o f c o n c e n t r a t i o n camps f o r r e f u g e e s and p e a c e f u l c i t i z e n s , c r u e l t r e a t m e n t o f p r i s o n e r s , t o r t u r e , m u t i l a t i o n , the systematic-destruction o f d i p l o m a t i c m i a s i o n a , aftd thé a n n i h i l a t i o n of s c i e n t i f i c and c u l t u r a l i n s t i t u t i o n s . Those crimes had a l s o been discussed at the Semiimr on v i o l a t i o n s of human r i g h t s i n the Pâlestir4an. and other Arab t e r r i t o r i e s occupied by I s r a e l . The Seminar 'had concluded t h a t the v i o l a t i o n o f human r i g h t s i n t h e o c c u p i e d t e r r i t o r i e s would cease o n l y when the P a l e s t i n i a n people were allowed to enjoy t h e i r r i g h t to self-dete-xffi.ination and when I s r a e l i occupation ended. I t had condesmed the I s r a e l i i n v a s i o n of Lebanon as an i l l e g a l act i n a l l i t s aspects, an.d most participmsts had ooncluded that I s r a e l had cosmiitted a c t s which · f e l l c l e a r l y w i t h i n the d e f i n i t i o n s of war crimes, the crime of genocide and o r i a e s against h u a a n i t j . The idea of imposing sanctions upon I s r a e l analogous to those impcjsed on South A f r i c a was worthy of e p e c i a l a t t e n t i o n . E/CN ,4/ I:?G 3/ SR.5 page 7 19. The Government o f I s r a e l was o p e n l y i g n o r i n g S e c u r i t y C o u n c i l r e s o l u t i o n s 5O8 ( I 9 8 2 ) and 509 (1982) and a t t e m p t i n g t o s t r e n g t h e n i t s p o s i t i o n i n Lebanon. The b l o o d y events i n Lebanon were a d i r e c t consequence o f t h e Camp i)avid a c c o r d s and a m a n i f e s t a t i o n o f the I s r a e l i p o l i c y o f f i n i s h i n g o f f the A r a b - c o u n t r i e s one by one. P r i m a r y r e s p o n s i b i l i t y f o r t h e c r i m e s i n Lebanon and the o t h e r o c c u p i e d Arab t e r r i t o r i e s r e s t e d on the r u l i n g c i r c l e s i n I s r a e l , b u t those had p l a c e d weapons i n the a g g r e s s o r ' s hands were a l s o g u i l t y . The events were a d i r e c t consequence o f the " s t r a t e g i c a l l i a n c e " between I s r a e l and the u n i t e d S t a t e s , and Washington c o n t i n u e d to seek a d d i t i o n a l bases i n the M i d d l e E a s t . 20. W h i l e the U n i t e d S t a t e s had f o r m e r l y attempted- t o hide i t s e x p a n s i o n i s t p o l i c y i n the r e g i o n , i t now took a d i r e c t and a c t i v e p a r t on the s i d e o f I s r a e l i n events i n t h e M i d d l e E a s t . S i n c e 1951> I s r a e l had r e c e i v e d c r e d i t s o f around' $15 b i l l i o n f o r the p u r c h a s e ' o f weapons from t h e U n i t e d S t a t e s , whose economic and fflilitufy aid to I s r a e l would -exceed $2 b i l l i o n i n 19S3. I s r a e l s i m p l y c o u l d not have'laùïîched i t s new phase o f a g g r e s s i o n a g a i n s t the Arab peoples w i t h o u t U n i t e d S t a t e s s u p p o r t ; Washington was now t r y i n g t o d i s s o c i a t e i t s e l f from the crimes w h i c h had been committed, p a r t i c u l a r l y a t S a b r a and C h a t i l a , but i n t e r v e n t i o n i n those camps had been d i s c u s s e d e a r l i e r by t h e I s r a e l i l e a d e r s and M u r r a y D r a p e r , Reagan's r e p r e s e n t a t i v e i n t h e M d d l e E a s t . When, a t i t s emergency s p e c i a l s e s s i o n , t h e G e n e r a l A-sseiÊbly had adopted a r e s o l u t i o n demanding t h e w i t h d r a w a l o f I s r a e l i f o r c e s f r o m L e h a n o h , o n l y I s r a e l and t h e U n i t e d S t a t e s had opposed t h e r e s o l u t i o n , thus showing who'was t h e c r i m i n a l and who i n s p i r e d t h e I s r a e l i r u l i n g c i r c l e s t o commit 'the crimes t h e y committed. I s r a e l and; t h e U n i t e d S t a t e s had a l s o opposed the a d o p t i o n o f G e n e r a l Assembly r e s o l u t i o n 57/86, which, acknowledged t h e r i g h t o f t h e P a l e s t i n i a n Arab people t o s e l f - d e t e r m i n a t i o n . 21. The o b s e r v e r f o r I s r a e l had s a i d n o t h i n g i n response t o t h e a c c u s a t i o n s o f human r i g h t s v i o l a t i o n s l e v e l l e d a g a i n s t h i s Government. That was i i n d e r s t a n d a b l e : he s i m p l y c o u l d n o t deny what everyone knew. He had, however, attempted t o p o i n t t o h-uman r i g h t s v i o l a t i o n s everywhere e l s e except i n t h e o c c u p i e d t e r r i t o r i e s . ; A c c u s i n g o t h e r s o f h y p o c r i s y , he had gone beyond h y p o c r i s y by a s s e r t i n g t h a t t h e huJiiári'rî^ts s i t u a t i o n i n the o c c u p i e d t e r r i t o r i e s had improved a f t e r thousands o f women, e l d e r l y people and c h i l d r e n ' h a d p e r i s h e d i n West B e i r u t and t h e sumexatidn o f Arab t e r r i t o r i e s had been i n t e n s i f i e d . B u t n o t h i n g e l s e could'be expected o f an I s r a e l i : such was t h e l o g i c iof t h e a g g r e s s o r . However, the a g g r e s s o r and h i s p r o t e c t o r had not accomplished t h e i r g o a l s ; t h e y had not b r o u g h t the P a l e s t i n i a n o r Lebanese p e o p l e s to t h e i r k n e e s . 22. There was a r e a l chance t o c o - o r d i n a t e t h e a c t i o n s o f a l l those who sought a j u s t peace i n the a r e a . The S o v i e t U n i o n favoured a comprehensive s e t t l e m e n t i n t h e M i d d l e E a s t . w h i c h p r o v i d e d f o r t h e f u l l and u n c o n d i t i o n a l w i t h d r a w a l o f I s r a e l i f o r c e s ' f r o m a l l A r a b territotóes o c c u p i e d s i n c e I 9 6 7 , i n c l u d l h g e a s t e r n Jerusalemy and t h e enjoyment, by t h e P a l e s t i n i a n A r a b people o f i t s i n a l i e n a b l e ' n a t i o n a l r i g i i t s , i n c l u d i n g the;righ-t-_to e x e r c i s e s e l f - d e t e r m i n a t i o n , c r e a t e an independent S t a t e arid r e t u l r a t o t h e i r Iwrnesi . The-Middle E a s t problem c o u l d not be s o l v e d uñiese'the P a l e s t i n i a n problem was s o l v e d , and t h a t could n o t be done w i t h o u t t h e p a r t i c i p a t i o n o f the PLO, t h e s o l e l e g i t i m a t e r e p r e s e n t a t i v e o f t h e P a l e s t i n i a n p e o p l e . An e f f e c t i v e way o f a c h i e v i n g a tarue s e t t l e m e n t i n the M i d d l e E a s t :would be to convene an i n t e r n a t i o n a l c o n f e r e n c e in'-which t h e PLO should p a r t i c i p a t e t o g e t h e r w i t h o t h e r interested parties. The Commission must condemn I s r a e l ' s gross and massive v i o l a t i o n s o f human r i g h t s i n the o c c u p i e d A r a b t e r r i t o r i e s and must c a l l on a l l S t a t e s and p e o p l e s t o e x e r t p r e s s u r e on the I s r a e l i r u l i n g c i r c l e s i n order, t o end t h e i r o c c u p a t i o n o f the Arab t e r r i t o r i e s and Lebanon. I t should demand t h a t the U n i t e d S t a t e s cease a l l support f o r the c r i m i n a l p o l i c y o f I s r a e l i n r e s p e c t o f t h e A r a b S t a t e s and the P a l e s t i n i a n Arab p e o p l e . I t s h o u l d s t r e s s t h a t t h a t p e o p l e , l e d by the PLC, must soon be g i v e n the o p p o r t u n i t y t o e x e r c i s e i t s r i g h t o f s e l f - d e t e r m i n a t i o n , i n c l u d i n g the r i g h t t o e s t a b l i s h an independent S t a t e . To d e p r i v e the P a , l e s t i n i a n p e o p l e o f t h a t , . r i g h t was a v e r y s e r i o u s crime w h i c h mankind c o u l d not condone. 24. Mr. MARTIItEZ ( A r g e n t i n a ) · s a i d t h e Commission s h o u l d ask i t s e l f whether i n i t s d i s c u s s i o n o f the v i o l a t i o n o f human r i g h t s i n the o c c u p i e d A r a b t e r r i t o r i e s , i n c l u d i n g P a l e s t i n e , i t was d e a l i n g m e r e l y w i t h the e f f e c t s and n o t w i t h the c a u s e s . a t e r r i t o r y was o c c u p i e d by f o r c e by a f o r e i g n Power,: a permanent i n j u s t i c e , w h i c h c o u l d o n l y be m a i n t a i n e d t h r o u g h the s y s t e m a t i c v i o l a t i o n o f human r i g h t s , ' was i n s t i t u t e d . Such s i t u a t i o n s were by t h e i r v e r y n a t u r e a c o n s t a n t t h r e a t t o i n t e r n a t i o n a l peace and s e c u r i t y . 25. . . H i s d e l e g a t i o n s t r o n g l y opposed the c o n t i n u e d p r e s e n c e o f the i n v a d e r i n t h e occupied'Arah t e r r i t o r i e s : i t s p r e s e n c e c o n s t i t u t e d an a f f r o n t t o t h e i n t e r n a t i o n a l commiinity and t o t h e l e t t e r and s p i r i t o f t h e C h a r t e r . The defence o f the t e r r i t o r i a l i n t e g r i t y o f S t a t e s was one o f the p i l l a r s o f the U n i t e d N a t i o n s system and the b a s i s f o r c o e x i s t e n c e among n a t i o n s . A c c o r d i n g l y , the c o n t i n u e d o c c u p a t i o n o f t e r r i t o r i e s and t h e i r f o r c i b l e a n n e x a t i o n j e o p a r d i z e d the v e r y e x i s t e n c e o f the U n i t e d N a t i o n s system and r e p r e s e n t e d a s e r i o u s s e t b a c k i n the e v o l u t i o n o f contemporary i n t e r n a t i o n a l l a w . 26. The e x p l o s i v e s i t u a t i o n i n the M i d d l e E a s t .had. now been exacerbated by f u r t h e r , i n v a s i o n s o f the t e r r i t o r i e s o f S t a t e s , as a r e s u l t . o f w h i c h massive v i o l a t i o n s o f human, r i g h t s had p r o l i f e r a t e d , i n c l u d i n g i n e x c u s a b l e , a t t a c k s on r e f u g e e camps and^. the a s s a s s i n a t i o n o f c i v i l i a n s . H i s d e l e g a t i o n was h o r r i f i e d a t the massacres i n ' the S a b r a and C h a t i l a r e f u g e e camps and c a l l e d - f o r an end t o the i n v a s i o n w h i c h had f a c i l i t a t e d those c r i m e s . I t v i g o r o u s l y r e j e c t e d the u n i l a t e r a l measures used by I s r a e l t o change the l e g a l s t a t u s , geography and demographic c o m p o s i t i o n o f the o c c u p i e d t e r r i t o r i e s i n f l a g r a n t v i o l a t i o n o f the f o u r t h Geneva C o n v e n t i o n and numerous G e n e r a l Assembly and Commission r e s o l u t i o n s . I t opposed the I s r a e l i o c c u p a t i o n o f Lebanese t e r r i t o r y and the p r e s e n c e o f f o r e i g n armed f o r c e s i n vi-olation of s p e c i f i c S e c u r i t y Council r e s o l u t i o n s . 27. He,drew a t t e n t i o n to the s i t u a t i o n i n the h o l y c i t y o f J e r u s a l e m , the .xmilateràl o c c u p a t i o n o f w h i c h c o m p l i c a t e d the s i t u a t i o n s t i l l f u r t h e r . As S e c u r i t y C o u n c i l r e s o l u t i o n 476 (198O) i n d i c a t e d , ' t h a t problem c o u l d be s o l v e d o n l y on the b a s i s o f h i s t o r i c and c u l t u r a l v a l u e s by C h r i s t i a n s , Jews and Moslems, a l l o f whom regarded the c i t y as t h e i r s p i r i t u a l h e r i t a g e . A p o l i c y o f f a i t a c c o m p l i c o u l d not c o n f e r l e g i t i m a c y , s i n c e i t v i o l a t e d the p r i n c i p l e o f n o n - a c q u i s i t i o n o f t e r r i t o r i e s by f o r c e . 28. . H i s . d e l e g a t i o n had always f u l l y supported the s e l f - d e t e r m i n a t i o n o f the. m a r t y r e d P a l e s t i n i a n p e o p l e , w h i c h had u n i q u e c h a r a c t e r i s t i c s d i f f e r e n t i a t i n g i t . from o t h e r p e o p l e s i n the r e g i o n and c e n t u r i e s - o l d r o o t s i n the t e r r i t o r y which, i t i n h a b i t e d . A n i n t e g r a t e d s o l u t i o n t o t h e M i d d l e E a s t c o n f l i c t meant t h a t a l l S t a t e s i n t h e a r e a would have t h e r i g h t to, e x i s t w i t h i n m u t u a l l y r e c o g n i z e d and s e c u r e b o u n d a r i e s . The J e w i s h and P a l e s t i n i a n p e o p l e s wfere tvra r e a l i t i e s b y w h i c h t h e Commission's work must be g u i d e d . .The a ; c t i v i t i e s o f u n i t e d N a t i o n s b o d i e s and e f f o r t s b y t h e S e c r e t a r i a t were f a r from a r h e t o r i c a l and i n e f f e c t u a l e x e r c i s e ; o n t h e c o n t r a r y , i t was p r e c i s e l y i n forums' l i k e t h e Commission t h a t p r o g r e s s had begun t o be made i n o b t a i n i n g j u s t i c e f o r t h e P a l e s t i n i a n p e o p l e . H i s d e l e g a t i o n hoped t h a t t h a t p r o g r e s s would c o n t i n u e t h r o u g h d e c i s i o n s adopted b y t h e Commission a t i t s c u r r e n t session. 30. Mr. BHAGAT ( I n d i a ) s a i d t h a t because o f , i t s c o m p l e x i t y and t h e e n o r m i t y o f t h e human r i g h t s v i o l a t i o n s i n v o l v e d , , t h e s u b j e c t under d i s c u s s i o n was a t e s t case f o r the Commission, w h i c h would be judged i n tea^ms o f i t s success o r f a i l u r e i n r e s t o r i n g b a s i c human r i g h t s t o t h e u n f o r t u n a t e p e o p l e o f P a l e s t i n e . Any m o r a l o r p o l i t i c a l p r e s s u r e w h i c h t h e Commission had been a b l e t o e x e r t had so f a r been a r r o g a n t l y d i s r e g a r d e d b y t h e Government o f I s r a e l , and t h e b r u t a l s u p p r e s s i o n o f the r i g h t s o f t h e P a l e s t i n i a n p e o p l e had n o t l e t up. That r e p r e s e n t e d a s i n g u l a r f a i l u r e on,, the p a r t o f t h e Oommission and t h e i n t e r n a t i o n a l community. 31. S i n c e t h e Commission's p r e v i o u s s e s s i o n , events i n t h e o c c u p i e d t e r r i t o r i e s and Lebanon had p o i g n a n t l y r e v e a l e d t h e sad p l i g h t o f t h e P a l e s t i n i a n p e o p l e . I s r a e l had c o n t i n u e d i t s p o l i c y o f f o r m a l a n n e x a t i o n o f Arab t e r r i t o r i e s t h r o u g h t h e e s t a b l i s h m e n t o f s e t t l e m e n t s , which" had l e d t o a change i n t h e demographic c o m p o s i t i o n o f those t e r r i t o r i e s . The P a l e s t i n i a n s were thus b e i n g turned i n t o a l i e n s i n t h e i r own t e r r i t o r y , where t h e y were d e n i e d t h e r i g h t s t h a t were t h e i r due under t h e Cha,rter and o t h e r i n t e r n a t i o n a l i n s t r u m e n t s . The o c c u p a t i o n had r e s u l t e d i n t h e d e n i a l o f the b a s i c r i g h t o f s e l f - d e t e r m i n a t i o n and o f p o l i t i c a l , c i v i l , s o c i a l and c u l t u r a l r i g h t s t o t h e i n d i g e n o u s P a l e s t i n i a n p o p u l a t i o n . _ The economy o f t h e o c c u p i e d t e r r i t o r i e s was c o m p l e t e l y subjugated t o t h e I s r a e l i economy. S i n c e the "occupied t e r r i t o r i e s v;ere governed b y I s r a e l i m a r t i a l - l a w a u t h o r i t i e s , t h e freedoms o f e x p r e s s i o n , assembly, á'ssociation and r e l i g i o n , t o g e t h e r w i t h t h e o t h e r fundamental r i g h t s oT t h e P a l e s t i n i a n s , had been s e v e r e l y curbed. 32. N o t o n l y had t h e P a l e s t i n i a n s been d e n i e d t h e i r b a s i c human r i g h t s i n t h e i r homeland, b u t those of. them who "had t a k e n r e f u g e i n f o r e i g n l a n d s had b e e n hoiinded from p l a c e ' t o p l a c e and massacred as p a r t o f a c a l c u l a t e d e x t e r m i n a t i o n campaign. The massacres a t S a b r a and C h a t i l a , p e r p e t r a t e d w i t h t h e connivance o f t h e I s r a e l i a u t h o r i t i e s , vrere a b l o t on t h e c o n s c i e n c e o f t h e i n t e r n a t i o n a l community. I n u t t e r d i s r e g a r d o f t h e f o u r t h Geneva C o n v e n t i o n , t o w h i c h I s r a e l was a p a r t y , a t r o c i t i e s had been committed a g a i n s t t h e i n n o c e n t c i v i l i a n , p o p u l a t i o n . There had a l s o been r e p o r t s t h a t P a l e s t i n i a n p r i s o n e r s vrere b e i n g t o r t t i r e d and k i l l e d b y t h e I s r a e l i a u t h o r i t i e s . The impact t h a t t h a t s t a t e o f p e r s e c u t i o n and u n c e r t a i n t y would have on t h e g e n e r a t i o n o f P a l e s t i n i a n s s u r v i v i n g t h e g e n o c i d e was i n c a l c u l a b l e . Not o n l y h a d t h e P a l e s t i n i a n s s u f f e r e d p h y s i c a l and e m o t i o n a l u p r o o t i n g , but younger g e n e r a t i o n s would grow up i n a s t a t e o f p h y s i c a l , m a t e r i a l , e d u c a t i o n a l and p s y c h o l o g i c a l d e p r i v a t i o n . The h m a n cost i n h e r e n t i n t h e s i t u a t i o n made t h a t e p i s o d e one o f t h e most h a r r o w i n g o f r e c e n t h i s t o r y . 34» S i n c e i t s independence, I n d i a had c o n s i s t e n t l y s u p p o r t e d t h e r e a l i z a t i o n o f t h e i n a l i e n a b l e r i ^ t s o f t h e P a l e s t i n i a n p e o p l e , w i t h o u t w h i c h t h e r e c o u l d be no peace i n w e s t e r n A s i a . The c o u n t r i e s concerned and t h e i n t e r n a t i o n a l commtmity must s u p p o r t t h e s t r u g g l e waged b y t h e P a l e s t i n i a n p e o p l e under t h e l e a d e r s h i p o f t h e PLO, t o w h i c h I n d i a h a d g r a n t e d f u l l d i p l o m a t i c s t a t u s . I n d i a had i n c r e a s e d i t s c o n t r i b u t i o n t o t o 200,000 rupees i n 1982 and h a d p r o v i d e d an a d d i t i o n a l 200,000 rupees i n response t o an appeal from t h e C o m m i s s i o n e r - G e n e r a l . The Government o f I n d i a had c o n t i n u e d i t s programme o f s c h o l a r s h i p s t o P a l e s t i n i a n s t u d e n t s who had been d e n i e d a p r o p e r e d u c a t i o n i n t h e i r o c c u p i e d homeland and h a d d i s p a t c h e d a m e d i c a l m i s s i o n t o Lebanon t o care f o r s i c k and wounded P a l e s t i n i a n s who'had f a l l e n v i c t i m t o t h e I s r a e l i o n s l a u g h t . I t must, however, have f a i t h t h a t i t s vrards and deeds líould f o r c e t h e I s r a e l i a u t h o r i t i e s t o conform t o t h e s t a n d a r d s o f human r i g h t s eD ecteà from a p e o p l e which had been v i c t i m s o f such v i o l a t i o n s i t s e l f . M i s s i L i e ( Y u g o s l a v i a ) s a i d t h a t , even i f t h e s h o c k i n g " e v e n t s o f t h e p a s t y e a r i n t h e M i d d l e E a s t had not t a k e n p l a c e , t h e r e vrould have been numerous o t h e r i n s t a n c e s , o f v i o l a t i o n s o f human r i g h t s by I s r a e l f o r t h e Commission t o c o n s i d e r , I s r a e l and some o f i t s f r i e n d s defended such a c t s as t h e e x p u l s i o n o f Arabs from t h e i r homes, t h e e x p r o p r i a t i o n o f l a n d , t h e e s t a b l i s h m e n t o f J e w i s h s e t t l e m e n t s , d e p o r t a t i o n s , c o l l e c t i v e punishments, mass a r r e s t s and t o r t u r e as being'-normal, , l e g a l and j u s t i f i e d i m d e r a s t a t e o f o c c u p a t i o n . However, t h e o n l y l e g a l a c t i n a t e r r i t o r y o c c u p i e d by an i n v a d e r was t o r e s i s t and s t r u g g l e f o r l i b e r a t i o n and human d i g n i t y , 39. W i i l e >the s i t u a t i o n i n t h e o c c u p i e d Arab t e r r i t o r i e s had been d e t e r i o r a t i n g y e a r a f t e r y e a r , i t h a d changed Q u a l i t a t i v e l y as a r e s u l t o f t h e c a r e f u l l y c o - o r d i n a t e d a g g r e s s i o n a g a i n s t Lebanon and t h e massacres a t C h a t i l a and Sabra, w h i c h had been p l a n n e d a t an I s r a e l i c a b i n e t m e e t i n g on 15 J^mQ 1982 and had not been o f f i c i a l l y condemned b y a s e c t o r o f t h e i n t e r n a t i o n a l community which was o t h e r w i s e v e r y q u i c k t o r e a c t t o i n f i n i t e l y l e s s s e r i o u s events e l s e w h e r e . 40. The ,recent events l e f t no doubt about I s r a e l ' s r e a l aims. I s r a e l h a d n e v e r sought peace, except on i t s own t e r m s . I t was now o p e n l y a d m i t t e d t h a t I s r a e l sought d o m i n a t i o n o v e r p e o p l e s and c o u n t r i e s , even i f t h a t i m p l i e d t h e e x t e r m i n a t i o n o f an e n t i r e p e o p l e vihose r i g h t s v/ere b e i n g d e n i e d b y a "chosen p e o p l e " -jho c l a i m e d t h a t t h e i r r i g h t t o P a l e s t i n e was God-given. V/hat -was p a r t i c u l a r l y d i s t u r b i n g vras t h a t such views v/ere s u p p o r t e d by t h e h i g h e s t r e l i g i o u s a u t h o r i t i e s i n I s r a e l . A f t e r t h e r e c e n t events i n Lebanon, f r i e n d s and a l l i e s o f I s r a e l must make i t a b s o l u t e l y c l e a r t o t h e Government and people o f I s r a e l t h a t t h e i r concern, and support f o r t h a t c o u n t r y ' s r i ^ t t o e x i s t - a c o n c e r n s h a r e d b y t h e Y u g o s l a v d e l e g a t i o n - must not be c o n s t r u e d as support f o r , o r a p p r o v a l o f , i t s p o l i c y o f , a g g r e s s i o n and a n n e x a t i o n . 4 1 . I s r a e l had o f t e n attempted i n t h e p a s t t o j u s t i f y i t s a g g r e s s i v e a c t s b y i n v o k i n g a supposed t h r e a t t o i t s ovra s e c u r i t y . The s e c u r i t y o f I s r a e l v/as i n d e e d t h r e a t e n e d , b u t b y I s r a e l i t s e l f . I t was i l l u s o r y t o t h i n k t h a t I s r a e l c o u l d secTxre r e c o g n i t i o n f o r i t s r i g h t t o e x i s t by means o f vrar, t e r r o r and b l a c k m a i l . I t , c o u l d do so o n l y b y d e m o n s t r a t i n g i t s r e a d i n e s s t o l i v e i n peace w i t h i t s n e i g h b o u r s , t o r e c o g n i z e t h e r i g h t s and e q u a l i t y o f o t h e r s , t o become a p a r t o f t h e r e g i o n and t o work f o r i t s p e a c e f u l development and p r o g r e s s , 42. The q u e s t i o n o f s e l f - d e t e r m i n a t i o n f o r t h e P a l e s t i n i a n p e o p l e was t h e core o f t h e A r a b - I s r a e l i c o n f l i c t . No peace p l a n - w o u l d succeed i f i t was based on t h e d e n i a l o f t h e e x i s t e n c e o f an e n t i r e p e o p l e , f a i l e d t o r e c o g n i z e t h e P a l e s t i n i a n p e o p l e ' s r i g h t t o s e l f - d e t e r m i n a t i o n and t o e s t a b l i s h a S t a t e o f t h e i r own, o r e x c l u d e d ..dialogue w i t h t h e almost u n i v e r s a l l y r e c o g n i z e d r e p r e s e n t a t i v e o f t h e P a l e s t i n i a n p e o p l e , t h e PLO, E/CN.4/1983/SR.5 page 12 45. A f t e r the l a t e s t I s r a e l i a c t o f aggression, the Commission must make i t c l e a r that acts o f genocide committed against Jews i n the past could not and must not be accepted as a j u s t i f i c a t i o n f o r crimes against the P a l e s t i n i a n people. The Commission would be remiss i n i t s duty i f i t did not adopt a r e s o l u t i o n recognizing the r i g h t o f the P a l e s t i n i a n people t o self-determination, i n c l u d i n g the establishment o f i t s own State, c a l l i n g on a l l Member States t o declare p u b l i c l y t h e i r determination not to impede the r e a l i z a t i o n o f the P a l e s t i n i a n s ' r i g h t o f self-determination, and recognizing the r i g h t o f a l l States and peoples i n the area to l i v e i n peace and s e c u r i t y . Such a r u e o l u t i o n , i f adopted unanimously, would go a long way towards promoting peace and respect f o r human r i g h t s and fundamental freedoms and towards securing genuine freedom and independence f o r a l l peoples and countries i n the area. 44. Mr, ZAFBRA (Observer for Madagascar), said that the i n c l u s i o n o f item 4 i n the agenda attested t o the constant concern o f the i n t e r n a t i o n a l community riot only about the p l i g h t o f the P a l e s t i n i a n people but a l s o about the great threat which I s r a e l ' s c r i m i n a l actions posed t o world peace and s e c u r i t y . The various reports before the Commission contained damning proof o f I s r a e l ' s numerous v i o l a t i o n s o f human r i g h t s i n the occupied Arab t e r r i t o r i e s , i n c l u d i n g P a l e s t i n e . Instead o f complying with the many r e s o l u t i o n s o f the United Nations and other i n t e r n a t i o n a l organizations, I s r a e l continued to pursue a p o l i c y o f t e r r o r and t o deny the P a l e s t i n i a n people t h e i r i n a l i e n a b l e n a t i o n a l r i g h t s , i n c l u d i n g the r i g h t t o self-determination and independence. I t o b s t i n a t e l y continued t o e s t a b l i s h settlements and expel the Arab population, and refused t o apply the fourth Geneva Convention. Despite a l l the e f f o r t s of the i n t e r n a t i o n a l community, I s r a e l p e r s i s t e d i n i t s a t t i t u d e o f scorn, arrogance and cynicism, and was s t e a d i l y e s c a l a t i n g v i o l e n c e . The recent I s r a e l i aggression and genocide against the P a l e s t i n i a n and Lebanese peoples and, i n p a r t i c u l a r , the barbaric ma,ssacres a t Sabra and C h a t i l a were further manifestations o f I s r a e l ' s arrogant challenge t o the world. 45. At session a f t e r session, the Commission had adopted r e s o l u t i o n s condemning such acts and yet I s r a e l was pursuing with impunity i t s p o l i c y o f aggression and expansionism; the United Nations seemed powerless t o prevent the. most serious v i o l a t i o n s o f i n t e r n a t i o n a l law and human r i g h t s since the end o f the Second World War. The Commission must take e f f e c t i v e measures t o put an end to I s r a e l ' s c r i m i n a l actions, f a i l i n g which i n t e r n a t i o n a l peace and s e c u r i t y would be s e r i o u s l y threatened. 46. fiis delegation wished to .reaffirm i t s condemnation o f the p o l i c y o f aggression and expansionism of the Z i o n i s t regime and i t s support f o r the j u s t struggle o f the P a l e s t i n i a n people under the leadership o f i t s sole legitimate representative, the PLC. The P a l e s t i n i a n question was the crux o f the problem o f the Middle East, and there could be no question o f a separate peace, as envisaged i n the Camp David accords. What was required was a comprehensive peace based on respect f o r the i n a l i e n a b l e r i g h t s of the P a l e s t i n i a n people, i n c l u d i n g i t s r i g h t t o s e l f determination and to e s t a b l i s h an independent State, and on the withdrawal o f I s r a e l from a i l occupied Arab and P a l e s t i n i a n t e r r i t o r i e s , i n c l u d i n g Jerusalem, 47. I n southern A f r i c a , human r i g h t s and the r i g h t s o f peoples continued t o be f l o u t e d . The r a c i s t regime i n P r e t o r i a was r e i n f o r c i n g i t s p o l i c y of apartheid and stepping up i t s repression against the black population, while i t s continued i l l e g a l occupation of Namibia was accompanied by a growing number o f v i o l a t i o n s o f the most basic human right-T and a f u r t h e r outbreak o f armed aggression against neighbouring States. Israel was attempting to destroy Lebanese unity and break the s p i r i t of the Palestinian people on the pretext of eliminating the PLO. Israel's occupation troops remained i n Lebanon and the Palestinian people continued to be the victims of terrorism, deprived of a l l t h e i r humanitarian and human r i g h t s . That noble people had been suffering for decades because of Israel's actions and the protection and support Israel enjoyed from the Western i m p e r i a l i s t s . The establishment of settlements i n the occupied t e r r i t o r i e s was proof of Israel's expansionist and annexationist designs, which violated United Nations decisions aimed at securing the inalienable rights of the Palestinian people, e s p e c i a l l y t h e i r right of self-determination. The various aspects of Israel's aggression and expansionism and i t s violations of the Charter and of fundamental human rights were well documented i n the reports prepared by various United Nations bodies and other international organizations. The Commission, f o r i t s part, must adopt a resolution unequivocally recognizing the necessity of an I s r a e l i withdrawal from the occupied t e r r i t o r i e s and reaffirming the inalienable rights of the Palestinian people, including t h e i r right to return to t h e i r homeland and to establish a State of their own there under the leadership of the PLO. 5 4 . Mr. KUDRIAVTSEV (Afro-Asian People's S o l i d a r i t y Organization) said that his organization was deeply concerned about the gross v i o l a t i o n s of human r i g h t s which had accompanied Israel's occupation of Lebanon and other Arab t e r r i t o r i e s . He had been a member of the international commission of inquiry into the crimes committed by Israel against the Lebanese and Palestinian peoples. That commission had found I s r a e l to be g u i l t y of a series of crimes against humanity, including genocide and other gross v i o l a t i o n s of fundamental norms of international law. Responsibility for those crimes must be borne by the g u i l t y party and those who aided and abetted i t * 5 5 . The international commission had reached several conclusions with regard to the s i t u a t i o n i n Lebanon and other occupied Arab t e r r i t o r i e s . I t considered that the continued I s r a e l i occupation of a large part of the sovereign State of Lebanon represented a gross and premeditated v i o l a t i o n of the p r i n c i p l e s of international law and must be declared an international crime. There was i r r e f u t a b l e evidence that the I s r a e l i authorities were provoking acts of violence i n Lebanon and fomenting enmity between various groups of the population, including the Moslem and Christian communities. The I s r a e l i occupation was d e s t a b i l i z i n g the p o l i t i c a l system of Lebanon and disrupting a l l normal a c t i v i t i e s . Under the occupation gross violations of human rights were occurring, including mass a r r e s t s , torture and the internment of c i v i l i a n s i n concentration camps. The occupation represented a very serious v i o l a t i o n of the sovereignty and i n t e g r i t y of Lebanon and of international law and human r i g h t s , and was an obstacle to the achievement of a just and comprehensive settlement i n the Middle East, including recognition of the right of the Palestinian people to form a State of t h e i r own. 5 6 . I s r a e l invoked rather strange arguments to J u s t i f y i t s behaviour, including the assertion that some people were better o f f under the I s r a e l i occupation and that t e r r o r i s t s were to blame for the s i t u a t i o n . Similar arguments had been used by the H i t l e r i t e s to defend their conduct i n occupied t e r r i t o r i e s but such arguments could hardly be taken seriously i n the l a t t e r part of the twentieth century. E/CN.4/1983/SR.5 page 15 57. The International commission had also concluded that the s i t u a t i o n i n Lebanon could be ended only through the immediate, f u l l and unconditional withdrawal of I s r a e l i forces as a f i r s t step towards the f u l l restoration of Lebanon's sovereignty and the normalization of l i v i n g conditions there. I s r a e l must bear f u l l r e s p o n s i b i l i t y for a l l acts of violence committed i n Lebanon under i t s occupation and c o n t r o l . Responsibility must also be borne by those who made the I s r a e l i occupation p o s s i b l e , f i r s t and foremost the United States. The presence of United States m i l i t a r y contingents i n Lebanon was not conducive to an end to I s r a e l i aggression against that country. The ways and means of implementing resolutions of the Security Council and other international bodies could be found by holding an international conference on the Middle East, with the p a r t i c i p a t i o n of a l l parties on an equal f o o t i n g , including the PLO. 58. His organization f u l l y endorsed the conclusions reached by the international commission and hoped that the Commission on Human Rights would take e f f e c t i v e measures to put an end to the I s r a e l i occupation of Arab t e r r i t o r i e s and ensure the f u l l implementation of a l l United Nations resolutions on the subject. 59. Mr. SOFFER (Observer for I s r a e l ) , speaking i n exercise of the right of r e p l y , said that at i t s 3 r d meeting the Commission had been subjected to one of the most contemptible statements i t had ever heard. The r a c i s t hysteria of the speaker i n question was on a par with the most loathsome pages of H i t l e r propaganda. I t was appalling that such a statement should have been made only days a f t e r the f i f t i e t h anniversary of H i t l e r ' s accession to power, when the world was remembering the worst campaign of anti-semitism i n h i s t o r y . The Commission was supposed to promote human dignity and must not become a vehicle for neo-Nazi racism. The statement by the speaker i n question Insulted the Ideals of the Commission, the i n t e l l i g e n c e of. Its members and human dignity i n general. He could understand that some delegations, wishing to cover up t h e i r own Governments' human rights v i o l a t i o n s , might choose to slander I s r a e l . He could not, however, allow the Jewish people again to be the victim of such savage provocation and barbarous racism. 60. The speaker concerned represented a Government which was notorious for i t s racism. In that country, over 1,000 c i t i z e n s had disappeared or been executed over the past three years and the torture of p o l i t i c a l prisoners had become a matter of routine. The dictator of that country had vowed to liquidate a l l his opponents and even sent his thugs to other countries to eliminate fellow c i t i z e n s who had chosen to l i v e abroad. The intolerance and r e l i g i o u s fanaticism of that dictator had become a code of conduct and he was proud of his anti-Jewish views. To quote only one example, on 25 January 1985 he had stated i n an interview with the French newspaper Le Matin that i t was Zionism's aim to rule the world or destroy i t , that the Zionists were t r a i n i n g young people i n various economic f i e l d s so that they might undermine the world economy, that the current world economic c r i s i s was the r e s u l t of the p r o l i f e r a t i o n of Zionists i n a l l areas of economic l i f e and that Zionists might one day even take charge i n the White House or the Kremlin or i n the c a p i t a l of some other major power. According to that same d i c t a t o r . H i t l e r had realized what the Zionists planned to do and that they wished to rule Germany, and had acted to stop them. E/CN.4/I9ë5/SR.5 page 16 61. Such i n t e l l e c t u a l o b s c e n i t i e s d i d not deserve c o n t r a d i c t i o n . I t s h o u l d be n o t e d , however, t h a t they bore a v e r y c l o s e resemblance t o the a n t i - s e m i t i c propaganda p u b l i s h e d i n T s a r i s t R u s s i a a t the t u r n o f the c e n t u r y . Mr. 1 ( L i b y a n Arab J a m a h i r i y a ) , s p e a k i n g on a p o i n t o f o r d e r , observed t h a t the Commission was used t o Z i o n i s t propaganda and would not be i n t i m i d a t e d by the Z i o n i s t r e p r e s e n t a t i v e ' s obscene s t a t e m e n t s , which were t o t a l l y out o f p l a c e and showed a l a c k o f r e s p e c t f o r the Commission and a l l those p r e s e n t . A t the Commission's 5rd m e e t i n g , the same speaker had i n s u l t e d the Commission. The Commission a l w a y s . t r i e d to be o b j e c t i v e , and,was c u r r e n t l y c o n s i d e r i n g items 4 and 9? namely I s r a e l i v i o l a t i o n s o f human r i g h t s i n the o c c u p i e d t e r r i t o r i e s , i n c l u d i n g P a l e s t i n e . 63. The Z i o n i s t representative had wept crocodile tears over the innocent victinjs of the c i v i l war i n Lebanon, y e t that War, a l l previous c i v i l wars i n Lebanon and indeed a l l the troubles of the Arab peoples', e s p e c i a l l y the P a l e s t i n i a n people, had been caused by the p r a c t i c e s imposed by I s r a e l on the P a l e s t i n i a n people ever since 194Q · 79 · He would not comment on the I s r a e l i statement that the Sabra and C h a t i l a massacres had been a s e t t l i n g of scores between Lebanese C h r i s t i a n s and P a l e s t i n i a n Moslems. He would simply remind the Commission that I s r a e l i p u b l i c opinion had i t s e l f accused the I s r a e l i Government of c o m p l i c i t y i n the preparation f o r , and even execution o f , the massacres. The findings of the I s r a e l i commission of i n q u i i y i n t o the massacres had been \}ell p u b l i c i z e d and, although i t s work was not y e t complete, that commission had already pointed an accusing f i n g e r at Menachem Begin, A r i e l Sharon and I t z a k Shamir. 30. He also wished to r e f e r to a statement by Camille Chamoim, former President of Lebanon and current head of the I s r a e l i - p r o t e c t e d Lebanese C h r i s t i a n Front, \"Jhich had been reproduced i n Monde on 1 Februaj?y 1983s according to Itr. Chaiaoun, i f any doubt had remained as to the d u p l i c i t y of the I s r a e l i Government, A r i e l Sharon had d i s p e l l e d i t by p r o v i d i n g i r r e f u t a b l e proof that I s r a e l was purs-uing i t s own i n t e r e s t s and no one else's i n Lebanon, to the detriment of Lebanon's sovereignty and t e r r i t o r i a l integrity. 81. Mr. SAKEE (observer f o r the Syrian Arab E e p u b l i c ) , speaking i n exercise of the r i g h t of r e p l y , said that h i s delegation would i t s statement on items 4 and 9 at the folloii/ing meeting but wished to respond to some of the coraments made by the observer f o r I s r a e l , who c l e a r l y could not t o l e r a t e the accusations l e v e l l e d against his country. No one loiew exactly what had happened at Sabra and C h a t i l a , but the observer f o r Isra.cl had been l y i n g when he had accused S y r i a and the PLO of genocide against the Lebanese C h r i s t i a n s . S y r i a did not discrinjinate between C h r i s t i a n s .and Moslems. I t s delegation to the Commission comprised both C h r i s t i a n s and Moslems, while ·fche PLO delegation yas made up e n t i r e l y of C l i r i s t i a n s . Neither S y r i a nor the PLO would ever oppose a C h r i s t i a n or a Jew on the grounds of h i s r e l i g i o n , but they did oppose the human r i g h t s v i o l a t i o n s perpetrated by the r a c i s t and repressive Z i o n i s t Government. 82. The anno-unoed that the informal working group of 10 members to be set up pursuant to Commission r e s o l u t i o n 1932/40 to consider the p o s s i b i l i t y of r a t i o n a l i z i n g the Commission's agenda would c o n s i s t of the f o l l o w i n g States: Argentina, A u s t r a l i a , Cuba, I n d i a , I r e l a n d , Japan, Senegsl, Union of Soviet S o c i a l i s t Republics, United Republic o f Teinzania and Yugoslavia.
