Annex to the identical letters dated 24 October 2007 from the Permanent Representative of Lebanon to the United Nations addressed to the Secretary-General and the President of the Security Council Lebanese Government position paper on the implementation of Security Council resolution 1701 (2006)
20 October 2007 In anticipation of the periodic review of the Secretary-General on the implementation of Security Council resolution 1701 (2006), the Lebanese position on the outstanding key elements in the resolution is set out below. 1. Lebanon remains entirely committed to the full implementation of resolution 1701 (2006) and abides by its obligations under it. 2. The cooperation between the Lebanese Armed Forces (LAF) and the United Nations Interim Force in Lebanon (UNIFIL) continues to be strengthened through coordinated control and patrolling along the Litani River and in UNIFIL's area of operations, where the situation remains relatively calm. However, since the previous review of the resolution, LAF recorded that the Israeli forces have persistently committed 290 air, 24 maritime and 52 land violations in just over three months. (Attached is the list of violations as provided by LAF covering the period between 14 June and 10 October 2007.) These violations constitute repeated breaches not only of the Blue Line and of Security Council resolution 1701 (2006), but also of other relevant Security Council resolutions by which the international community affirmed and reaffirmed its strong commitment to the sovereignty and territorial integrity of Lebanon and called upon all parties to respect them. We reiterate that violations of our territorial sovereignty cannot be justified under any pretext, including the enforcement of the arms embargo as per Security Council resolution 1701 (2006). The resolution did not commission Israel with this task. Furthermore, Israel should abide by its obligations under resolution 1701 (2006) and show respect for Lebanese sovereignty and for the international community. 3. Tripartite meetings held periodically remain the appropriate venue to address the issue of marking the Blue Line and dealing with all emerging tensions caused by unilateral Israeli actions on Lebanese territory. In this context, we reaffirm that the internationally recognized borders of Lebanon in the south are as referred to in the 1949 Armistice Agreement, and as reiterated in paragraph 5 of resolution 1701 (2006). 4. We welcome the fact that LAF and UNIFIL on one side, and UNIFIL and the Israeli army on the other side, agreed to a series of practical measures to mark the Blue Line using coordinates established by the United Nations in 2000. The territorial implementation of that agreement has begun on the Lebanese side, with cooperation between UNIFIL and LAF, and we look forward to the speedy continuation of this process. 5. Israel continues to occupy the northern part of the village of Ghajar in breach of the Blue Line and of resolution 1701 (2006). Our position remains clear: Israel should withdraw from the Lebanese part of Ghajar without any further delay and without any prior conditions, as per its obligation under that resolution. then move into the liberated area in anticipation of the deployment of LAF there, as the latter deems appropriate. 6. The 15-week battle in Nahr el-Bared, during which LAF fought and succeeded in uprooting the Fatah al-Islam terrorist group, confirmed that the borders are porous and that it is a matter of national security interest for Lebanon to secure its border, in conformity with relevant Security Council resolutions, in order to prevent any infiltration of personnel or smuggling of weapons aimed at destabilizing Lebanon. In this context, the Lebanese Government welcomed the recommendations of the Lebanon Independent Border Assessment Team on that matter; however, it reiterates that the control of the northern and eastern borders is a responsibility shared by both Syria and Lebanon, as per paragraph 15 of resolution 1701 (2006). It therefore looks forward to establishing cooperation with its Syrian counterparts, in particular at the operational level, in a joint effort to secure the border and prevent illegal cross-border activities. The competent Lebanese authorities adopted an integrated strategy to enhance their capabilities in controlling the border from the Lebanese side and are maintaining a high level of vigilance with regard to illegal movements of arms and materiel; further technical and logistical support is needed to enhance their capabilities in the fulfilment of their tasks. The German assistance provided through the pilot project in the north continues to be helpful in that regard. In the same spirit, the Syrian Government will have to take tangible steps to prove it is cooperating in controlling its border to prevent infiltration into Lebanon of arms and personnel. The circumstances of Fatah al-Islam's infiltration into Lebanon, as set out in the Lebanese Prime Minister's letter to the Secretary-General of 8 October 2007, further underscores this point. In this context, the Lebanese Government looks forward to the positive outcome of initiatives launched by the Arab League and the European Union, including technical assistance and effective and reliable monitoring support when needed. Furthermore, we request again that any information in the possession of any third country about illegal smuggling of arms or persons be shared with us directly, if possible, or through the United Nations. 7. On the question of the Lebanese detainees in Israeli prisons, we continue to insist that their detention is a breach of the basic rules of international law and that those prisoners be released immediately and unconditionally. As for the Israeli soldiers abducted on 12 July 2006, the Lebanese Government reiterates that it has no knowledge of their status or whereabouts and remains ready to cooperate with the Secretary-General, who is mediating on this issue, whenever he deems it appropriate to do so. In this context, the Lebanese Government notes that Israel has been engaged in indirect negotiations with Hizbullah through the United Nations appointed mediator, which led to a first exchange of detainees and bodies on 15 October 2007, while at the same time continuing to make allegations that the Lebanese Government is in breach of resolution 1701 (2006) regarding the release of the two abducted Israeli soldiers. 8. The Israeli army pounded Lebanon with millions of cluster bombs. The 2006 annual report of the United Nations clearly specifies that more than 1 million remain unexploded and are thus tantamount to anti-personnel landmines, claiming lives on a daily basis. The latest victim -- but not the last -- was 6-year-old Ali Dakdouk, whose first day at school became his last, as a result of this horrible and lethal type of ordnance. We request that Israel submit to the United Nations, without any further delay, the maps which indicate where it dropped the cluster bombs. Those

cluster bombs remain a continuing threat to the civilian population in the south and represent a humanitarian crime for which Israel bears responsibility and for which it will have to pay compensation to Lebanon. 9. Regarding landmines, Israel claims to have submitted all maps relating to landmines laid in Lebanon prior to its withdrawal in 2000. It has been agreed in the tripartite meetings that any further discoveries of landmines will be brought to the attention of this forum and that the Israeli army will submit related maps in its possession. 10. Israeli withdrawal from the Shebaa farms remains a yet-to-be-completed element of Security Council resolution 425 (1978). We praise the progress achieved by the senior cartographer appointed to determine the territory of those farms and we look forward to seeing the results of his work in the forthcoming report, which will enable the Secretary-General to start a long-overdue political process based on our suggestion in the seven-point plan that the area be placed under United Nations custodianship after the withdrawal of the Israeli occupying forces, until such time as it is possible to demarcate the border between Lebanon and Syria. Progress on the Shebaa farms issue is not conditional on progress on other elements of resolution 1701 (2006), as per paragraph 10 of that resolution, which requested the Secretary-General to develop proposals to deal with the Shebaa farms area. Furthermore, the continuing occupation of the Shebaa farms hinders the extension of the authority of the Lebanese State throughout its territory as called for by the international community and stands as a direct affront to the resolve of the Lebanese Government to be the sole guarantor of Lebanese sovereignty. 11. We consider that Security Council resolution 1773 (2007), adopted on 24 August, was a strong political message regarding the continued commitment of the international community to the role of UNIFIL and the fulfilment of its mandate in the south of Lebanon, especially given the fact that it has been the target of cowardly terrorist attacks. 12. We consider that, based on the important measures taken by the Lebanese Government and LAF to extend their authority throughout Lebanese territory and to guarantee peace and stability, it is essential to move from the precarious situation of a cessation of hostilities to a permanent ceasefire. 13. On the economic front, we reiterate the call upon the international community in resolution 1701 (2006) to consider further assistance for the reconstruction and development of Lebanon. In that context, we urge the States that participated in the Stockholm and Paris III conferences to fulfil their pledges.

IDF forces fired /4/ shells near AL NAQAR POOL and AL SEDANEH. IDF forces pointed a spotlight on the village of MAYS AL JABAL. At 8.40 hrs an IDF patrol consisted of four ( 4 ) Hammer vehicles was moving from the IDF pos. W416 to pos. W414 when (8) soldiers alighted from it and took fighting positions against the LAF pos abeam BP12. In addition to this, a Hammer vehicle was WEST of IDF pos W414. Two (2) soldiers alighted from it and also took a fighting position and directed their weapons towards the same LAF position. One of the soldiers took pictures for the Lebanese soldiers and for their position. The two (2) IDF patrols left at 8.50 hrs. Today at 17.30 hrs, around /15/ cows crossed the withdrawal line for about /200/ meters in AL ROUSS mountain close to the IDF pos N471and left at 20.00 from the point (UTM 752391 ­ 690276). IDF forces fired /2/ illuminated shells over TALET AL HADAB from above AALMA SHAAB. IDF forces fired automatic weapons around its post in AL RADAR position. An IDF tank Mircava came from the IDF position W423 and W425 (121950 - 128400) and pointed its Cannon towards the Lebanese side. An Israeli civilian car between TALET HAROUN W423 and W425 took pictures on the Lebanese side. (14) cows crossed the withdrawal line from occupied CHEBAA FARMS to the NORTH of RWAYSET AL AALAM (UTM 752346 ­ 690174) towards the Lebanese territory and left at 20.30 hrs.

Today at 19.30 hrs, a Lebanese citizen called Fares Hamdan from CHEBAA has reported that when his son MAHER was tending a herd of goats near the withdrawal line (756802 ­ 691363), an IDF patrol stopped him for 15 minutes and took him 300 meters towards the occupied territory before releasing him. At 21.00 hrs from the top of AL SHAHEL mountain UTM (7569 ­ 6914) SOUTH WEST of IDF position N473, (12) twelve tracer bullets (medium ­ calibrated) fired from that site towards Lebanese territory. (15) cows crossed the withdrawal line from occupied CHEBAA FARMS to the NORTH of RWAYSET AL AALAM towards Lebanese territory. (11) cows crossed the withdrawal line from occupied CHEBAA FARMS to the NORTH of RWAYSET AL AALAM (UTM 752346 ­ 690174) towards Lebanese territory and left at 9.20 hrs. A light beam was pointed from IDF position W411 towards MARWAHIN village. (4) Israeli citizen took a picture of the street of KFARKILA ­ AADYSEH in front of FATIMAH Gate. (7) cows crossed the withdrawal line from occupied CHEBAA FARMS to the NORTH of RWAYSET AL AALAM towards Lebanese territory and left at 20.00 hrs. (2) Israeli citizen took a picture of the street of KFARKILA ­ AADYSEH in front of FATIMAH Gate. On 15/08/2007 at 18.00 hrs, while an IDF patrol consisting of one vehicle (Hammer) was passing nearby B88, some IDF soldiers threw a smoking material to the other side of the blue line in TALET AL HAMAMES " UTM ( 739695- 686235), causing fire in an area of /20/ m². IDF soldiers took a picture of the Lebanese territory and of LAF position in front of ALMA SHAAB. (6) Israeli citizen took a picture of the Lebanese territory in front of KFARKILA left at 11.50 hrs.
