Noting the announcement of the government of Myanmar to hold a national referendum and elections; Noting also the recent visit by the Special Envoy of the Secretary-General to Myanmar, Ibrahim Gambari, while expressing deep concern at the rejection of all his recommendations, including on the need for international monitoring of the announced constitutional referendum in May 2008; Being deeply concerned at the continuing deterioration of the living conditions and the increase of poverty affecting a significant part of the population throughout the country, with serious consequences for the enjoyment of their economic, social and cultural rights; Expressing its deep concern at the situation of human rights in Myanmar, including the violent repression of the peaceful demonstrations of September 2007, and the failure of the Government of Myanmar to investigate and bring to justice the perpetrators of these violations; Expressing its deep concern at the continuing high number of political prisoners, including those detained in the wake of the peaceful protests of September 2007, and the extension of the house arrest of the General Secretary of the National League for democracy, Daw Aung San Suu Kyi. 1. Strongly condemns the ongoing systematic violations of human rights and fundamental freedoms of the people of Myanmar, continued arbitrary detentions and the continuing high number of political prisoners; 2. Strongly urges the government of Myanmar to receive, without any delay,, a follow up mission by the Special Rapporteur on the situation of human rights in Myanmar, as requested by the Human Rights Council in its resolution 6/33, to cooperate fully with him/her and to follow up and implement the recommendations contained in the report A/HRC/6/14; 3. Strongly calls upon the Myanmar authorities to a) make the constitution-drafting process inclusive, participatory and transparent in order to ensure that the constitution is broadly representative of the views of all the people of Myanmar, b) engage urgently in a reinvigorated national dialogue with all parties with a view to achieving genuine national reconciliation, democratization and the establishment of the rule of law, c) ensure to its people basic freedoms and desist from further denial of basic freedoms, such as the freedom of expression, assembly and religion or belief, and to immediately release all political prisoners without any condition, d) cooperate fully with humanitarian organizations, including by ensuring full, safe and unhindered access of humanitarian assistance to all persons in need throughout the country, e) take urgent measures to put an end to violations of human rights and humanitarian law of persons belonging to ethnic groups and to end forced displacement of large numbers of persons; 4. Invites the Special Rapporteur to continue to discharge his/her mandate in a coordinated manner with the Special Envoy on Myanmar of the United Nations Secretary-General; 5. Rrequests the Special Rapporteur to report to the next session of the Council on the implementation of the Council resolution S-5/1 and the subsequent Council resolution 6/33; 6. Requests the Office of the United Nations High Commissioner for Human Rights to provide the Special Rapporteur on the situation of human rights in Myanmar with adequate support, including expert human resources, to facilitate the fulfillment of the mandate entrusted to him by the present resolution; 7.
