The Preparatory Committee for the Durban Review Conference held its second substantive session in Geneva from 6 to 17 October 2008, in accordance with General Assembly resolution 61/149 of 19 December 2006 and Human Rights Council resolutions 3/2 of 8 December 2006 and 6/23 of 28 September 2007. It held 19 plenary meetings during the session. 2. The session was opened by Ms. Najat Al-Hajjaji (Libyan Arab Jamahiriya) Chairperson of the Preparatory Committee. 3. At the 1st meeting, on 6 October 2008, the United Nations High Commissioner for Human Rights made a statement. 4. At the same meeting, the President of the Human Rights Council made a statement. 5. The session was attended by representatives of Member States of the United Nations, non-member States and Palestine, United Nations funds, agencies and programmes, inter-governmental organizations, human rights bodies and mechanisms, National Human Rights Institutions and non-governmental organizations as found in the attendance list in annex III of the present report. 6. For a list of the decisions adopted by the Preparatory Committee, see annex I. For the list of documents issued for the second substantive session of the Preparatory Committee, see annex IV. ADOPTION OF THE AGENDA 7. At its 1st meeting, on 6 October 2008, the Preparatory Committee had before it the provisional agenda of its second substantive session (A/CONF.211/PC.3/1) and the annotations to the provisional agenda, prepared by the Secretary-General (A/CONF.211/PC.3/1/Add 1). 8. The Preparatory Committee adopted its agenda without a vote. For the text as adopted, see annex II. ORGANIZATION OF WORK 9. At its 1st meeting, on 6 October 2008, the Preparatory Committee considered a draft decision entitled “Organisation of work of the second substantive session”, as proposed by the Bureau. The resolution was adopted without a vote. For the text as adopted, see annex I, decision PC.3/1. 10. At the same meeting, the Preparatory Committee considered a draft decision proposed by the Bureau which would give members of the Organization of the Islamic Conference 48 hours to make comments on the accreditation of the following six NGOs: Humanrights.ch/MERS, ABGLT, People for Peace and Defence of Human Rights, Terre Nouvelle, Nepal National Dalit Social Welfare Organisation and the Bilaal Justice Center. The Preparatory Committee decided to defer the taking of a decision on the accreditation of these NGOs by 48 hours. 11. At the same meeting, the Preparatory Committee also considered the issue of the accreditation of the NGO International Dalit Solidarity Network. Interventions were made by India, France (on behalf of the European Union), Pakistan, Algeria, Sweden, Russia, Morocco, Germany, South Africa (on behalf of the African Group), Cuba, Nigeria, Denmark, Zimbabwe, Bangladesh and Egypt. The Preparatory Committee decided to defer the taking of a decision on the accreditation of this NGO for 48 hours. 12. At its 6th meeting, on 8th October 2008, the Preparatory Committee adopted the decision to accredit the NGO International Solidarity Network without a vote. France (on behalf of the EU) made an intervention. For the text as adopted, see annex I, decision PC.3/6. 13. At its 1st meeting, on 6 October 2008, the Preparatory Committee considered the issue of the accreditation of the following NGOs: NGOs Gherush92 Committee for Human Rights and Bexley Council for Racial Equality. The Preparatory Committee decided, without a vote, to accredit these two NGOs. For the text as adopted, see annex I, decision PC.3/2. 14. At the same meeting, the Preparatory Committee considered the granting of additional time to the Governments of India, Iran and Indonesia to make comments on the accreditation of the NGOs National Campaign on Dalit Human Rights, Swadhikar, and People’s Education for Action and Liberation. (see document A/CONF.211/PC.3/7/Add.1). Upon the recommendation of the Bureau, the Preparatory Committee decided to extend until Friday 10 October the taking of a decision on the accreditation of these NGOs. 15. At its 9th meeting, on 10 October 2008, the Preparatory Committee decided to accredit the NGOs National Campaign on Dalit Human Rights, Swadhikar, and People’s Education for Action and Liberation. For the text as adopted, see annex I, decision PC.3/7. 16. At its 6th meeting, on 8 October 2008, the Preparatory Committee also noted the request of the Government of Iran to receive further information from the NGO ABGLT. The Preparatory Committee decided to defer for 5 days the taking of a decision on the accreditation of this NGO. France (on behalf of the EU) and Brazil made interventions. The Preparatory Committee then decided, without a vote, to accredit the following other 5 NGOs: Humanrights.ch/MERS, People for Peace and Defence of Rights, Terre Nouvelle, Nepal National Dalit Social Welfare Organisation, Bilaal Justice Center. For the text as adopted, see annex I, decision PC.3/5. 17. At its 17th meeting, on 16 October 2008, the Preparatory Committee continued consideration of the accreditation of the NGO ABGLT. A decision was adopted, without a vote, to accredit this NGO. For the text as adopted, see annex I, decision PC.3/8. Iran expressed reservations with regard to this decision. Statements in explanation of vote were made by Egypt (on behalf of the African Group) and by France (on behalf of the EU). 18. At its 1st meeting, on 6 October 2008, the Preparatory Committee considered the issue of the accreditation of the provisionally accredited NGOs Centre for Community Economics and Development Consultants Society, Rural Development Centre and Buddha Smriti Sanathan, which had failed to provide information requested of them by the Preparatory Committee at its first substantive session. The Preparatory Committee decided, without a vote, not to accredit these NGOs. For the text as adopted, see annex I, decision PC.3/3. 19. At its 2nd meeting, on 6 October 2008, the Preparatory Committee considered and adopted the draft timetable proposed by the Bureau. The Preparatory Committee then considered the rules applicable to speaking time limits and decided as follows: The speaking-time limits would be 5 minutes per statement for States Members of the United Nations and 3 minutes for all observers; The speaking time for joint statements by States Members should not exceed 10 minutes; The speaking-time limits for joint statements by non-governmental organizations would be as follows: 1 to 2 non-governmental organizations: 3 minutes; 3 to 5 non-governmental organizations: 4 minutes; 6 to 10 non-governmental organizations: 5 minutes; more than 10 non-governmental organizations: 6 minutes. 20. At its 5th meeting, on 8 October 2008, the preparatory Committee decided to apply the following rules to the process of negotiations and drafting under agenda item 6: a facilitator from each regional group was identified and a section of the outcome document was attributed to each. South Africa (on behalf of the African Group), Chile (on behalf of GRULAC), Russia, Denmark, Argentina and China (on behalf of the Asian Group) made interventions. It was decided that observers would participate in the discussions under item 6 by making interventions after Governments had made their interventions but not during the drafting process itself. 21. At the 7th meeting, on 9 October 2008, of the Preparatory Committee, it was decided that non-governmental organisations and other observers would be given the possibility to make oral statements with regard to the drafting process after each reading of each section of the draft outcome document is completed. 22. At the 10th meeting, on 10 October 2008, a discussion was held on organizational issues related to agenda item 6. The following Member States took the floor: Honduras, Egypt, France (on behalf of the EU), South Africa (on behalf of the African Group), United Kingdom, Nigeria, Switzerland, Singapore, Egypt, New Zealand, Syria and Nigeria. REPORTS OF PREPARATORY MEETINGS AND ACTIVITIES AT THE INTERNATIONAL, REGIONAL AND NATIONAL LEVELS V. REVIEW OF REPORTS, STUDIES AND OTHER DOCUMENTATION FOR THE PREPARATORY COMMITTEE AND THE DURBAN REVIEW CONFERENCE AND CONTRIBUTIONS OF HUMAN RIGHTS BODIES AND MECHANISMS VI. REPORT OF THE INTERSESSIONAL OPEN-ENDED INTERGOVERNMENTAL WORKING GROUP TO FOLLOW UP THE WORK OF THE PREPARATORY COMMITTEE 23. At its 2nd and 3rd meetings, on 6 and 7 October 2008, the Preparatory Committee considered items 3, 4 and 5 of the agenda jointly. Statements were made by South Africa (on behalf of the African Group), Cuba (on behalf of the Non Aligned Movement), France (on behalf of the EU), Pakistan, China (on behalf of the Asian Group), Nigeria, Brazil, Algeria, Azerbaijan, Argentina, Mauritius, the United Kingdom, Turkey, Egypt, Switzerland, Indonesia, Italy. The following observers also took the floor: ILO, Special Rapporteur on contemporary forms of racism, racial discrimination and related intolerance and the Special Rapporteur on freedom of religion and belief. The Touro Institute on Human Rights and the Holocaust, the Hudson Institute and the International Association of Jewish Lawyers and Jurists made a joint statement. The Canadian Arab Federation and the African Canadian Legal Clinic made another joint statement. IMDAR, the Lutheran World Federation, Forum Asia and APWLD also made a joint statement. B’nai B’rith International, UN Watch, the Afro-Swedish National Association, MAPP, the Foundation for Aboriginal and Islander Research Action, the International Youth and Student Movement for the UN and the Canadian HIV Legal Network also made statements. VII. DRAFT OUTCOME DOCUMENT OF THE DURBAN REVIEW CONFERENCE 24. At its 3rd to 17th meetings, from 7 to 17 October, the Preparatory Committee considered agenda item 6 entitled “Draft outcome document of the Durban Review Conference”. At its 3rd and 4th meetings, interventions were made by Argentina, France (on behalf of the EU), South Africa (on behalf of the African Group), Egypt, Cuba, Greece, Belgium, Bangladesh and Nigeria. Interventions were made by South Africa (on behalf of the African Group), Chile (on behalf of GRULAC), China (on behalf of the Asian Group), Denmark (on behalf of WEOC) and Ukraine (on behalf of the Eastern European Group). Interventions were also made by Syria, Greece, Bangladesh, Norway, Singapore, Egypt, Switzerland, Russia, France (on behalf of the EU), the United Kingdom, Argentina, Mexico, Iran, India, Cuba, Algeria and New Zealand. 25. At its 6th meeting, on 8 October 2008, the Preparatory Committee continued its discussions under item 6. South Africa (on behalf of the African Group) intervened. Iran, Russia, France (on behalf of the EU), Norway, Argentina, Nigeria, Pakistan, Egypt, Morocco and Algeria also intervened. Discussions then began on section 1 of the outcome document (Review of progress and assessment of implementation of the Durban Declaration and Programme of Action by all stakeholders at the national, regional and international levels, including assessing contemporary manifestations of racism, racial discrimination, xenophobia and related intolerance), with the facilitation of Mr. Osita Anaedu of Nigeria. Pakistan, South Africa (on behalf of the African Group), France (on behalf of the EU), Syria, Switzerland, China (on behalf of the Asian Group), India, Algeria, Chile (on behalf of GRULAC), Colombia, Angola, Brazil, the Philippines, Argentina, Iran, the United Kingdom, Indonesia, Mexico, Bangladesh, New Zealand, Russia and Senegal made statements. 26. At its 7th and 8th meetings, on 9 October 2008, the Preparatory Committee continued its consideration of item 6, of section 1 of the outcome document. France (on behalf of the EU), Switzerland, Rwanda, India, Morocco, Algeria, Ireland, South Africa (on behalf of the African Group), Belgium, Syria, Denmark, Angola, Chile (on behalf of GRULAC), Egypt, Benin, Brazil, China (on behalf of the Asian Group), the United Kingdom, Iran, Argentina, Bangladesh, Indonesia, Romania, Senegal, Mexico, Greece, Italy, Nigeria, Russia and Colombia made statements. 27. At the same meeting, the following observers made interventions: a member of the Committee on the Elimination of Racial Discrimination, a member of the Working Group of Experts on People of African Descent, Indigenous Peoples and Nations Coalition, Foundation for Aboriginal and Islander Research Action, Canadian Arab Federation, Mouvement contre le Racisme et pour l’Amitié entre les Peuples, Canadian HIV/AIDS Legal Network, Badil Resource Centre for Palestinian Residency and Refugee Rights, Afro-Swedish National Association, International Labour Organisation and Red de Mujeres Afrocaribenas, Afrolatinoamericanas y de la Diaspora. Human Rights First and the Leadership Conference on Civil Rights Education Fund made a joint statement. Interfaith International, MBORORO and the Al-Hakim Foundation also made a joint statement. 28. At its 7th and 8th meetings, on 9 October 2008, the Preparatory Committee began discussions of section 2 of the outcome document (Assessment of the effectiveness of the existing Durban follow-up mechanisms and other relevant United Nations mechanisms in order to enhance them) under the facilitation of Mr. Sebastian Rosales of Argentina. South Africa (on behalf of the African Group), Chile (on behalf of GRULAC), Algeria, France (on behalf of the EU), Colombia, Switzerland, Bangladesh, India, Brazil, Mexico, Indonesia, Senegal, Egypt, Iran, Benin, the Philippines, Syria and Belgium made statements. The following observers also made statements: a member of the Working Group of Experts on People of African Descent, the Afro-Swedish National Association, Indigenous Peoples and Nations Coalition, Coordination des Pueples Autochtones –Afrique and Mouvement contre le Racisme et pour l’Amitié entre les Peuples. 29. At its 9th meeting, on 10 October 2008, the Preparatory Committee continued its consideration of agenda item 6, with a focus on section 4 of the draft outcome document of the Durban Review Conference (Identification and sharing of best practices achieved at the national, regional and international levels in the fight against racism, racial discrimination, xenophobia and related intolerance). Discussion of this section was facilitated by Mr. Yuri Boychenko of the Russian Federation assisted by Ms. Natalia Zolotova. At its 9th meeting, on 10 October 2008, the Preparatory Committee continued its consideration of agenda item 6, with a focus on section 3 of the draft outcome document of the Durban Review Conference (Promotion of the universal ratification and implementation of the International Convention on the Elimination of All Forms of Racial Discrimination and proper consideration of the recommendations of the CERD). Discussion of this section was facilitated by Mr. Ali Onaner of Turkey. The following Member States made statements: South Africa (on behalf of the African Group), France (on behalf of the EU), Chile (on behalf of GRULAC), Switzerland, Honduras, Norway, Brazil, Senegal, Algeria, Egypt, Bangladesh, Iran and Libyan Arab Jamahiriya. A member of the Committee on the Elimination of Racial Discrimination made a statement. A statement was made by Indigenous Peoples and Nations Coalition. A joint statement was made by Red de Mujeres Afrocaribeñas y Afrolatinoamericanas, Colectiva Mujer y Salud Republica Dominicana, Instituto de la Mujer Negra Geledés Brazil, Afrolider Colombia, Enlace de Mujeres Negras de Honduras, Color Cubano (UNEAC) Cuba and Voces Caribeñas Nicaragua. 31. At its 10th meeting, on 10 October 2008, the Preparatory Committee continued its consideration of agenda item 6, with a focus on section 5 of the draft outcome document of the Durban Review Conference (Identification of further concrete measures and initiatives at all levels for combating and eliminating all manifestations of racism, racial discrimination, xenophobia and related intolerance, in order to foster the implementation of the Durban Declaration and Programme of action and to address challenges and impediments thereto, including in the light of developments since its adoption in 2001). Discussion of this section was facilitated by Mr. Dayan Jayatilleka of Sri Lanka assisted by Mr. Amir Jewed. At its 1st meeting, on 6 October 2008, the Preparatory Committee considered a draft decision proposed by the Bureau entitled “Invitation addressed to the High Commissioner for Human Rights”. Statements were made by Algeria, South Africa (on behalf of the African Group), Belgium, Egypt and Ireland. The Preparatory Committee adopted the draft decision, as amended, without a vote. For the text as adopted, see annex I, decision PC.3/4. 41. At its 19th meeting, on 17 October 2008, the Preparatory Committee had before it a draft decision on the continuation of the preparatory process proposed by the Bureau. The following Member States made interventions: Egypt, Pakistan, Singapore and France (on behalf of the EU). The decision was adopted without a vote. Singapore and Japan made statements. At the same meeting, the Preparatory Committee also considered a draft decision on a panel discussion at the Durban Review Conference proposed by the Bureau. The draft decision read as follows: “At its 19th meeting, on 17 October 2008, the Preparatory Committee, bearing in mind the objectives of the Durban Review Conference, decided to organize a panel discussion, following the high-level segment of the Review Conference, with the participation of four world renowned personalities and a moderator to be identified by the High Commissioner for Human Rights in consultation with the Bureau of the Preparatory Committee. The Preparatory Committee further decided that any costs associated with the panel discussion will be financed from extrabudgetary resources.” 43. The draft decision was subsequently withdrawn. 44. At the same meeting, the Preparatory Committee also had before it a draft decision on participation in the Durban Review Conference proposed by the Bureau. At its 19th meeting, on 17 October 2008, the Preparatory Committee had before it the draft report of its second substantive session. The draft report was adopted ad referendum, and the Preparatory Committee decided to entrust the Vice-Chairperson-Rapporteur with its finalization. 46. Accreditation of three Durban 2001 NGOs At its 1st meeting, on 6 October 2008, the Preparatory Committee, recalling that in its decision PC.2/5 A adopted at its first substantive session it decided to provisionally invite to the Durban Review Conference and its preparatory process the below mentioned NGOs that are not in consultative status with the Economic and Social Council but participated in the World Conference against Racism, Racial Discrimination, Xenophobia and Related Intolerance of 2001, pending the reception of further information that demonstrates that they fully satisfy the criteria for accreditation contained in Economic and Social Council resolution1996/31 and in accordance with Preparatory Committee decision PC1/2: Centre for Community Economics and Development Consultants Society Rural Development Centre National Campaign on Dalit Human Rights Buddha Smriti Sanathan and noting that no further information was received from the NGOs Centre for Community Economics and Development Consultants Society, Rural Development Centre and Buddha Smriti Sanathan, the Preparatory Committee decided not to accredit these three NGOs to the Durban Review Conference. Invitation addressed to the United Nations High Commissioner for Human Rights At its 1st meeting, on 7 October 2008, bearing in mind the objectives of the Durban Review Conference as well as the important role that the United Nations High Commissioner for Human Rights has been playing in the follow-up to the Durban Declaration and Programme of Action (DDPA), the Preparatory Committee decided to invite the High Commissioner to make a contribution to the Durban Review Conference through a report on the implementation of the DDPA and proposals to enhance its implementation and on the implementation of relevant decisions and resolutions of the General Assembly and the Human Rights Council. Accreditation of five new NGOs At its 6th meeting, on 8 October 2008, the Preparatory Committee decided to accredit the following new NGOs to the Durban Review Conference and its preparatory process: 1. Accreditation of the NGO International Dalit Solidarity Network At its 6th meeting, on 8 October 2008, the Preparatory Committee, having considered the application of the International Dalit Solidarity Network (IDSN), an NGO, for participation in the preparatory process to the Durban Review Conference, noting that the areas of activities of IDSN relate to caste-based discrimination and other forms of discrimination based on work and descent, and underlining that the participation of IDSN in the preparatory process of the Durban Review Conference would cover discrimination based on the ground of descent in line with the Durban Declaration and Programme of Action, decided, therefore, to grant accreditation to IDSN. Accreditation of the three NGOs National Campaign on Dalit Human Rights, Swadhikar, and People’s Education for Action and Liberation A At its 9th meeting, on 10 October 2008, the Preparatory Committee, having received further information from the NGOs in question, decided to accredit the following NGOs that were provisionally accredited at its first substantive session pending the reception of further information: Swadhikar National Campaign on Dalit Human Rights B At the same meeting, the Preparatory Committee, having received further information from the NGO in question, decided to accredit the following NGO that was not invited to participate at its first substantive session as it had not provided further information: Peoples Education for Action and Liberation. Accreditation of the NGO ABGLT At its 17th meeting, on 16 October 2008, the Preparatory Committee, having considered the application of the Brazilian NGO ABGLT for participation in the Durban Review Conference to be held from 20 to 24 April in Geneva, stressing that the participation of the ABGLT in the Durban review Conference would be based on addressing discrimination in conformity with the contents of the Durban Declaration and Programme of Action (DDPA) and shall strictly raise issues mentioned in the DDPA and in accordance with operative paragraph 5 of Resolution 3/2 of the Human Rights Council, decided, therefore, to grant accreditation to the ABGLT. Continuation of the preparatory process for the Durban Review Conference At its 19th meeting, on 17 October 2008, the Preparatory Committee, recalling General Assembly resolution 61/149 of 19 December 2006 and Human Rights Council resolution 3/2 of 19 December 2006 and bearing in mind the need to continue and conclude the process of negotiations on and drafting of the outcome document of the Durban Review Conference in advance of the Conference, decided: (a) To convene a third substantive session of the Preparatory Committee in Geneva for up to 3 working days, on 15 to 17 April 2009; (b) To establish an intersessional open-ended intergovernmental working group with a mandate to continue and finalize the process of negotiations on and drafting of the outcome document of the Durban Review Conference on the basis of the compilation of proposals resulting from the work of the second substantive session of the Preparatory Committee and any further contributions, and to report thereon to the third substantive session of the Preparatory Committee. The Preparatory Committee further decided that the intersessional open-ended intergovernmental working group shall meet for a total of up to 10 working days in advance of the third substantive session of the Preparatory Committee, including a meeting on 27 November 2008, the first session to be held from 19 to 23 January 2009, and the second session on 6 to 9 April 2009 or at any other date agreed by the working group. Bearing in mind the character of this compilation which is a document in progress reflecting the state of negotiations on the draft outcome document as at 16 October 2008, the compilation is being circulated as a separate document, and it will be made available to the intersessional open-ended intergovernmental working group which was established by the Preparatory Committee with a mandate to continue and finalize the process of negotiations on and drafting of the outcome document of the Durban Review Conference on the basis of this compilation and any further contributions (see decision PC.3/9 below).
