Explanation of Vote (EOV) by Chile before the General Assembly 64th Session Vote on Report of Fact Finding Mission on Gaza Conflict New York( 5 November 2009 CHILEAN REPRESENTATIVE: -- Chile would like to thank you for conducting, for organizing this meeting to discuss the report of the fact-finding mission. The report describes and analyzes in an international legal framework the allegations of violations of human rights that took place during the Cast Lead operation. Now during this period, fundamental principals of international humanitarian law were undermined, such as proportionality and the use of force, distinguishing between civilians and armed forces and precautions against harming civilians. Now Chile supports the establishment of a Palestinian state, as well as the right of Israel to live in secure borders. Chile also recognizes the right for legitimate self defense as it is articulated in article 51 of the charter of the United Nations, both in its form and principals, especially the principal of proportionality established in human -- in international law. Chile supports the resolution of the Human Rights Council and we endorse the recommendations of the fact-finding mission. Now we understand that the purpose of the recommendations contained in the report should be to investigate the allegations of serious violations committed by the Israeli army and armed Palestinian factions. Now we reiterate that we think that what's most important is upholding international humanitarian law and respect for human rights. It's essential to conduct an independent and credible investigations into the allegations of the facts that occurred, trying those who are responsible and ensuring reparations to the victims. Chile would like to make an appeal to all of the parties concerned to comply with their obligations. We'd like to take this opportunity to say that we supported the resolution given -- we'd like to emphasize the role that the Human Rights Council should play in ensuring the monitoring of compliance with the recommendations made by the fact-finding mission. Now the Human Rights Council should be the body that continues to examine the outcome of the investigations before referring that outcome to other bodies of the UN system. Finally, Chile would like to make an appeal to put an end to all the obstacles, the provocations and incitement to violence, whoever -- wherever they come from in order to establish conditions of trust in order to renew the negotiations that everyone yearns for and has yearned for such a long time.
