SUBMISSION:

This Commission of Inquiry is unprecedented in the history of the United Nations human rights system, by its own admission. With "no temporal restrictions," the Inquiry is a transparent attempt to turn back the clock prior to 1948, to relitigate the creation of the modern Jewish state in the face of continuous Palestinian Arab rejectionism, and to criminalize Jewish self-determination. The three members of this Inquiry have public records of anti-Israel bias and have already spoken on the very subject matter they are to investigate, including prior declarations that Israel is guilty of crimes against humanity and war crimes. Their appointment patently violates the UN's own rules requiring impartiality, objectivity, and independence. At a time when Israel's enemies are openly committed to genocide, the UN Human Rights Council has assumed power to create an anti-Israel inquisition to sit in judgment on Jewish history, on Jewish and Israeli law, and on application of the laws of war to Israeli self-defense without the facts. The Inquiry is a moral and legal outrage and the embodiment of modern antisemitism. There are, however, right answers to the questions that the Inquiry has rhetorically posed, regardless of its members' closed minds. These include: (1) "Root causes of recurrent tensions" and "systematic discrimination" - The continuous refusal of Palestinian Arabs and many Arab states to recognize and commit to peaceful coexistence with a Jewish state - Systematic Palestinian antisemitism (2) "Violations of international humanitarian law and international human rights law" - More than seven decades of attempts by Palestinian Arabs and their allies to eradicate a Jewish state, through violence and incitement to intolerance and hate (3) "Identification of those responsible" - Generations of Palestinian leaders openly committed to genocide, antisemitism, and Holocaust denial, including: Amin al-Husseini, Yasser Arafat, Mahmoud Abbas, Ahmed Yassin, Abdel Aziz Rantissi, Khaled Mashaal, Ismail Haniyeh - Generations of Palestinians, inculcated in hatred, who continue to repudiate peaceful coexistence with their Jewish neighbors and perpetrate violence (4) "Accountability measures" - Terminate the litany of UN bodies responsible for the demonization of Israel and the proliferation of modern antisemitism - Name and condemn the members of Hamas, other Palestinian terror groups, the Palestinian Authority, and the PLO, responsible for crimes against humanity and war crimes (5) "Measures to be taken by third States" - Defund and end the Commission of Inquiry as an obstacle to peace - Promote a negotiated peace between the parties - End funding to NGOs with ties to Palestinian terror organizations
